Don't know where you get your info, but otr per diem rate is around 57 or 58 dollars per 24 hour day away from home. I don't believe it has a annual qualifier except a log book page to collect it. This alone makes it worth filing long form. Plus you can claim cb radios, radar detectors, Satellite radio, bedding for the sleeper, shoes, uniforms, supplies like paper towels, paper pads, log books, pens, pretty much everything you buy on or for you or the truck.
I plug the number into the program at intuit and let it figure the actual dollar amounts, bit I know it does make a difference on my returns, but I have other stuff as well.

If you are working for the wrong company, living from paycheck to paycheck with no money in savings is going to happen whether you get your "per diem" or not.

Because things like Social Security, Workers Comp and Unemployment are calculated by your TAXABLE INCOME, WHO is the bigger loser; people taking the "per diem" or people opting out of that scam?
Not to mention, TAXABLE INCOME is used to figure out things like 'how much the bank is going to loan you' for that new(er) vehicle or for a new mortgage. -

It's illegal. I'd still pull a stunt like that regardless, cause....the IRS probably dont know that if they actually did audit me, and if they do...Well, thats for my car on my commute to work!

The problem is like...I claim per diem but i've moved umpteen times in the past year. Infact, at a recent job interview i was told.." you have uhm....a lot of addresses in the last 3 years <point at 3 pages of addresses>. sometimes this raises a red flag, but everything else looks fine...so i dont think its an issue.". So uhm..I dont have a clue where my werner logbooks are!
So what happens in a year or two when they audit me? They gonna disallow all those deductions?
I tell you what, if they ever do that, i'm leaving the country and never coming back. In the past two years i've lost basically everything i have ever owned. My important documents were basically thrown away by someone stealing my file folders. How am i supposed to prove all this crap? How come i'm not innocent til proven guilty?

If you claim a tax deduction, you had better have the records to support it. The dog ate my files, or someone stole them, won't hold up.
But I understand your point. When dealing with the IRS, you do indeed have to prove you are innocent.
