I got hurt at a job which required surgery on both shoulders. Upon release from the dr I went to get my dot physical but failed the lifting requirements. Dr said I would have to surrender my CDL. I went to the license bureau but they didn't say anything about down grading. So they took it, besides being Pissed at myself for not getting the facts. I need it, do I have any recourse ?
What can I do ?

The company you work for may have a physical lifting requirement. If the company sent you to see a doctor then it was their doctor, not yours representing their interests, not yours. It stands to reason that the company doctor would be very concerned about a situation where you might become a long term disability claim for the next 30-35 years.
That doctor only represents himself and his own opinion. There are thousands and thousands of doctors you can visit and many different companies you can apply to who may not have a weight lifting requirement.Farmerbob1, stillwurkin, Rideandrepair and 3 others Thank this. -
some companies have a stress test/agility sort of requirement, but many more do not.

Did the DMV actually downgrade your cdl or do you still have it?
I'd never mention the surgery again.

There are lifting requirements. I had to go through the crate test with dumbbells and sandbags but its not used for lifting, its used for heart rate so the DR is a BS

First of all, you should be able to self certify intrastate and keep the CDL without a physical. If this is a company physical and the company has added these requirements there is nothing you can do about this physical. You did not get that card. What I suggest is paying for your own physical for now. Make sure you tell the examiner about that first physical. This is CRITICAL! You should get at least a one-year physical!
