what if you can't make the DOT random drug test?

    I did make it.
    but only barely.
    6pm my guy calls. he never calls.
    Me- hey boss. whats up?
    My Dude- heyyy...ah.. hows it going?
    Me- good. making up time from an over weight loading this morning but I'll be there on time
    My Dude-well actually you got picked for this months random drug test. I'm sending you the address now.
    Me- seriously? I've got an hour left on my 14, I'm heading into Charlotte now. It's 6pm. Is there room for my trailer there?
    My Dude- it looks like you might be able to pull in the Office Depot lot next door...

    long story a little shorter... there's ZERO trailer spots in the 100 mile radius of that city. mostly lol. And the highway drivers are hateful.
    BUT- the city drivers are nice, I didn't get a ticket for being on the side of the street next to a string of NO PARKING signs, I did fit between parking lot entrances so that helped LOL and I made it in 20 minutes before they closed.

    I can Totally see not making it there before they closed tho.

    What happens then? Is that a refusal?

    Don't over-complicate this issue. If you can't make it to the testing site contact the safety dept ASAP. It's not a refusal.

    How much time did you have left after the test? It should be logged on duty. I would feel you did not have enough time to complete it. There for you should complete it at the start of next tour of duty.

    I got called for a random on my birthday 1 hour before concentra closed. I was so pissed off.

    They are supposed to give you 2 hours and make sure you can make it before notifying you. But then there are ######## in this world.

    Once you are notified for a random, you have two hours to get the test done. You can only be notified while on duty, just before you go on duty or at the end of a shift.

    You cannot be notified to take a random on your day off.

    Once there, you cannot leave until the test is completed. Failure to comply is viewed as a refusal, which is the same as a positive in the eye's of the FMCSA.

    That's only true for alcohol testing. For drug testing they can require it at any time. Heck, you can be on a boat in the Pacific and if you answer the phone and they notify you, you have to go.

    382.305 guidance question no. 21 regarding the 'unforeseen obstacle' such as the testing site is closed...

    Response: in instances of "unforeseen obstacles" the diver will immediately notify his DER for instructions to an alternate collection site. These "Unforeseen Obstacles" do not negate the employer's responsibility of ensuring that the required test be administered.

    DER is the person who runs the drug and alcohol program for the company and usually a little higher up the food chain than one';s dispatcher.

    The OP would remain on duty until another site was found and he went there and filled the cup...
