What qualifies as part time?

    I recently started a job that Im glad to have, but as a part time employee, I get no benefits (obviously why the company hires part time).

    I end up working over 40hrs a week, so i have to wonder where the line is drawn. There has to be a legal definition somewhere but i cant find it.

    depends on the company, typically its 35/wk or 70/2 wks dpends on pay
    least what i have seen for the avg

    There is no Federal definition of full or part time employment. From the U.S Department of Labor website:

    What state do you live in? Your state may have it's own definition of full or part time employment. Your company may also have a definition, is there an employee hand book?

    Unless you are in an exempt classification, you should be paid overtime after working 40 hrs in a week, regardless of your full or part time status.

    Truckers are generally exempt from overtime requirements.

    Screw legal definitions, the company is intentionally walking a line to spend less at YOUR expense. Find a better company, there's plenty out there. There are plenty of companies that don't do that and DO pay OT to work for a company that doesnt.

    In terms of what? In terms of health insurance under the ACA, full time is 30 hours per week, but I'm not sure if that has phased in. Even if it hasn't, they can pay the fine and not provide coverage.

    As to other benefits, you'd have to check with your state labor board. Some may and some may not require that there be a definition for who does and who doesn't get benefits.

    i can only say from my past jobs, anything under 40 hours is part time, and that is usually 35 hours, tops. many part time jobs, can be at the 20 hour limit as well. no employer likes to hit the 40 hour point for part time employee's, but again, that is here.

    here, if a job goes above 40 hours, it is full time. now here in lies a kick. you may work 40 hours this week, but only 10 next.

    i have had that happen to me..."ok, you worked 45 hours, so next week, do not come in on Monday or Tuesday, come in on Wednesday".......

    The norm used to be 32 hours for part time and 40 for full time.

    Actually there are federal laws and regs that cover this under the FLSA, even exempt employees.

    I would start with your state labor board to see if you can file a complaint with them.

    And where would one find these federal regs? The FLSA does NOT define full or part time employment.
    Generally, the definition of full or part time employment is defined by the employer, if it is defined at all.

    Some states may define full and part time employment. I know the state of Michigan does not.

    @snatale42 was absolutely correct. If you don't like the terms of your employment, your best bet is to find employment elsewhere.
