Here's the short version. I took my brother to the local smoke shop for tobaco supplies. The area and the smoke shop itself are both known to be friends with marijuana. I made an improper lane change leaving to smoke shop and was pulled over by a motorcycle officer and squad car that were watching the place.

Officer had me doing field sobriety tests for like 15 minutes and told me that he believed I was under the influence of marijuana. Towards the end, I actually started thinking that I was going for a ride to donate blood.

When he didn't put the brackets on, I knew he was bluffing, seeing if I'd slip. I'd have been more than compliant if asked to go downtown and give blood, but from what I've heard, if you're taken into custody for DUI, you are givin a DUI citation and the judge is left to look at the test results. If that happened, I'd have to tell my company and I'm sure they'd send someone out to pick up my truck.

question is, what is the right thing to do? Play with the officer on the side of the road or just insist on going downtown? Or, something else?

its obvious to me that he didn't truly believe that I was under the influence of anything, but seemed as tho he wanted me to be. If he honestly thought I was , I'd be in a cell right now.

If you know you are not guilty, give em hell!

And if you know you are guilty, play his game.

If you're innocent, like Spanking said, give them hell. CDL is on the line.

I'd take the word bashing over getting arrested any day. Arguing with the cops never does any good.
You were right by what you did. You told the officer you wernt on drugs and stood by it. Anything more would just be pushing it.

is this for real ?? Well what should I do if I already gave a lot lizard twenty dollars and I was all worked up and ready go & and then I reach down to the money zone and I find the enlarged sausage down there,Do I continue on....because I'm lonely & tired of doing things "on my own" and just pretend it never happened? Or do I allow my homophophia to take over & fly into a fit of rage and strangled the girl..er the dude and dump the corpse at the next rest area.??

If by "tobacco supplies" you mean a four foot bong, I'd say the officer was within his rights to assume that your brother's "tobacco supplies" would, in fact, not be used for tobacco. What exactly did your brother buy at this smoke shop?

That was my thinking. I know I'm innocent, I want to show that I'm innocent, but I didn't want to push much. Honestly, I was more worried about getting a ticket for an improper lane change than anything else... Until I started walking lines, poking my nose and counting to 30 with my eyes closed. I've watched enough episodes of "Cops" to know that "I'm going to be honest with you." Isn't something that you want to hear from law enforcement.

I will admit, I did change 2 lanes with a signal and the 3rd without. I'd have owned that if that's all it was.

Does it matter what those supplies were going to be used for? Its like buying a knife and an officer assumes that you will use it to stab someone and not chop up veggies! No he wasn't with in his right. All he had was the lane change fiasco and thats it.
