What should a driver do if accused of DUI?

    Yes, that does give me the winning hand when I see the judge, but that could be months down the road. Until then , I'd lose EVERYTHING.

    The best thing to say to the police is I don't talk to the police, I will remain silent and no I will not give permission to search myself or car

    Its called the 5th amendment you do not have to talk to the police ever

    It's also called articulable probable cause. An illegal lane change can be probable cause to suspect a driver is under the influence. Then it's off to county anyways. Lose, lose.

    Yes but anything u say will be used against you never for you if they can prove you lied to them that's a crime not talking not a crime

    I had nothing to hide. Nothing at all. I figured that complying was my best chance. And it worked this time.

    Are you saying that you'd rather go in for not complying than go home after complying?

    You break no laws saying u dont talk to the police the police can legally lie to you ands say different but most people end up in prison for what they say to the police most everyone in jail is there because of what they told the police not from the evidence the police had to start with and if u say you don't agree to a search they might still search but if they find something your attorney has a good chance of getting it suppress if u agree to it then it will be used against you and unless you bought your truck or car or whatever bran new and no one else has ever been in it or drove it are you really sure there is nothing illegal in that truck

    You're missing the point of this thread.

    The question was, what is the best thing to do in this circumstance. I hardly think that forcing a license suspension and DUI citation is in the best interest of a driver.

    No when they ask have u been drinking if you have been and u say no then u lied in a official investigation if you say u dont answer questions you stop that and if you say yes that you have been drinking then you just gave them the probable cause they were looking for but yes best way to not have that worry is don't drink and drive but that's a different story and if he did not get a ticket then he was not accused of anything
