What to do if you're being sued - 2 years after accident?

    Same thing happened to me.

    I was involved in a wreck that I wasn't cited for; the other guy was, but he still managed to sue my company and get paid.

    Now you know why all those lawyers have billboards along the interstates for big truck accidents. It doesn't matter who's fault it is, if you hit a truck, you will get money.

    @tbrown_sd He needs to be on the horn with Decker's legal team first thing tomorrow morning. Waste no time.

    Being the stubborn SOB that I am, I would have dragged it out as long as I needed to in order to win...then filed a claim for legal fees against the broad that hit me. She wouldn't have seen a dime from me, and I would have made sure to get a judgment against her and gone after her wages. Perhaps then, she'd get on Yelp and leave a review for her 1-800-sue-a-trucker lawyer saying how badly she had been screwed after allowing him to talk her into the bogus lawsuit, making it less likely the next fool will use them.

    As long as they get paid, they're going to keep coming after you.

    You're assuming you'd actually win the law suit...

    Wrong, wrong, wrong! The Plaintiffs (their names) vs. My husband (his name) and Decker Truck Line... That is the Complaint.

    Its gonna be a lot easier assuming your husband still drives for Decker.......

    Yes they sue you and the company. It is the responsibility of the insurance company to represent you and look after the case. This is why you need to inform the trucking company and the insurance company ASAP.

    OK why did you put damages AGAINST Decker's? Or did you mean FOR damages AGAINST decker?

    Nope, he does not... Money got bad and he had always had a hard time picking up from the "kill houses." For whatever reason, the Complaint lists Decker Truck Lines, Inc as "an international corporation." They used to be family owned.

    If I was stopped at a red light (like I'm supposed to be) and somebody rear ends me, how am I liable in ANY way for their injuries or damages? Was I supposed to run the red light to keep them from hitting me? Perhaps I should've just pushed the nice folks ahead of me out into the intersection to make room for the fool behind me to get stopped in time since they weren't going to get stopped before they hit my ICC bumper?

    When something is 100% your fault, don't come to me trying to get me to take responsibility for any of your blame...because I'll fight you every step of the way just on principal. People paying claims they shoudn't just to make the problem go away just leads to more problems down the road, because you've established a pattern for paying others who have involved you in their own screw-ups.

    Wow! Really...? Most folks seem able to understand what I meant...you just seem to want to split hairs.

    Your interpretation does not make sense to me.
