Wow. You come on here asking a bunch of truck drivers for advice, when you need to contact an attorney. Then one guy, only one, asks a question to make sure he understands your question, unlike everyone else that made an assumption, and you rail on the one guy? Sure, most of us made the correct assumption of what you meant, but there was some ambiguity in your post, so I can't blame Aradox for confirming he understood correctly before giving advice YOU asked for. But hey, this is the internet so lets all be dicks to each other because anonymity.

Just read this, sorry for your troubles.
So everyone agrees that the first thing to do is notify the Company. So their (team of) Lawyers are on it.
I "Liked" the previous post, on almost running out of the statute of limitations - another slimy lawyer trick.
You think that's coincidental? Not a chance. That's the norm, and SOP from the slimy Lawyer playbook.
Prepare a case for 2 years - and file with a month to go. Is their mouth moving? They are lying.
The advice for you both to clam up is good. Hope he took pictures at the time - could be real pivotal.
Were there witnesses, and statements, and Police reports? Again, if you got 'em, and they don't yet,
its a good thing. Look over police report for any witness names, and see if they remember anything helpful.
Contact officer who responded, and ask the same. You'd be surprised at what doesn't end up on paper.
If you do turn up anything important, get a signed, notarized statement for you to admit into evidence.
Same goes for Towing company; find out who worked, and ask, "hey - what do you remember on this one?"
Sure, you have to give them up to other side in the discovery phase, but - you do them, like they did you,
with their little last minute filing trick.
Not much on earth lower than a Lawyer. Till you need one.

You're forgetting one thing here. The whole reason they wait for 2 years to go by is because: A. They have the other story down, they've filmed it and they have it fresh, from the days right after the accident. B. They have the police reports and their own pictures already. They have witness statements from THE day it happened, or within a few days of it happening. C. The whole reason they wait is because they want YOU to be fuzzy on the details. They want you in court saying stupid things like "Hmm, I'm not sure, it was a long time ago" while their client (who just looked at the video of their side of the story again yesterday) is clear and concise and remembers it like it was yesterday so comes off far more believable.
Hate on lawyers all you want. But in most cases, they're smarter than you and I.

That's why I said what I said.
You are playing catch up here; gotta get on it.
I am just hoping they get some minor detail,
from the tips I included, that sways it in their favor.
Like the Tow truck driver smelled booze, or their towed vehicle had bald tires?
or the cop remembers opened containers in back seat?
Or witness remembers seeing them speeding?
Who knows what you come up with until you turn over all the rocks.
