It was an option I guess...but I don't really like the idea of being on the shoulder over a hill and around a curve where I can't be seen by the oncoming traffic, and thats where I would have been.
Didn't really think about it at the time...I just reacted based on what I saw.

One thing that I learned in law enforcement, that really does apply to truck driving: every once in a while, run different "what if" scenarios through your mind, and decide in advance what you are going to do. Of course you could do this 24/7/365, and there will STILL be something come up that you had not been able to for-see and plan for... -
Here's the thing that I see. You did the right thing for the situation. Going to the right *could* have caused a much hairier situation. You gotta think, since this was essentially a blind curve because of the declination of the hill, you don't know if the bear was sitting on the shoulder watching and waiting to catch someone in the wrong place. That would have been a lot worse than what he got, which was a court date and just has to go to traffic school... nothing compared to sitting in a jail rotting because you ran over a state trooper or a family that was stalled on the side of the road.

You had a load of steel. If you did some hard braking, your load mighty have shifted through the backside of your cab. If you hit him, you may have had the load come through the back of your cab.
Then again, if you hit him, he would have had to stop. And then he could explain the fresh blackmarks and flatspotted tires. Sounds like a local driver.
