What to do with a lying broker?

    Brokers are an important part of course and need to make money.

    I'd say we definitely have a different opinion on what a rate confirmation means. IMHO when things like delivery date change in nullifies the agreement and both parties should be happy with a new agreement.

    If that means the broker loses money on. The load then maybe next time he will be more upfront with the load details.

    I look at these type of issues as lost time and money. This load is going to interfere with what this truck is able to earn the next week. You can make more money.

    Ok so I have read every thing word for word.

    As a current broker and a veteran I can tell you this much and very simple.

    "Hi Robby. Your rate con says one date and receiver says another. Load will be delivered to a cold storage warehouse whether it's cold or dry and I am off this load and you can recover it."

    I PROMISE YOU he will be ####tting the bed because his customer is expecting delivery.



    As far as legal and all that it's nonsense and takes to long.

    Brokers can make any threats they want because we don't want #### to hit the fan. and explain to our bosses we messed up.


    It's simple. Truck gets stopped and unloaded and nearest warehouse.

    If they threaten the legendary "I'll file claim" then you will be better off because his boss will now have to talk to your insurance company and I PROMISE they are to busy to worry about a single load.

    Robby sends like a newbie and trying to show off his "skills".

    Kroger almost always unloads Monday morning, but they want you to be at the door Sunday around 20:00 to 22:00. Then you will wait while some lumper unloads and the freight receiver screws the pooch until as late as Monday 6:00

    The broker was lying and he knew it. He just told you what you wanted to hear so you will take the load. Same crap happens to company drivers. I sure he never had any intention of paying layover and I doubt it is in the contract.

    You can make an issue and try to contact a lawyer, but the retainer will cost you more then your lose of work for that weekend. The price will go up from there. In the end, chances are the contract you agreed too will not make any allowance for detention or layover. And even if it did, and it won't, no jury or judge will understand or be sympathetic to your situation and you will be stuck with court costs.

    They know all this, thats why you got screwed. That is why most drivers ask for who they are hauling and what. That way you can piece together what work the load entails. A company driver knows this fact, and knows how places like Krogers operates and they generally don't unload freight on Saturday morning.

    I agree and I fight till the end t
    Here is the situation, I pick up a load, something is wrong, I drop it in the storage, I have to put my name on it for the billing.
    Are you gonna file on my insurance and not pay for the load? Or are you gonna pay for storage fees and pay another truck to pick up that load?
    I understand that if the load is important, it won't go to the storage in the first place.
    But what happens when nobody cares? I remember there was a post here, about broker not picking up a phone for a week and guy not knowing what to do with that load?
    I also had a situation myself with broker lying to me about appt time, receiver not able to take me for a week, shipper not wanting it back and broker just wanting me to keep it for the whole week and not offer any money for that.

    The customer cares and I promise you sir it will never get to that because once customer is aware he will demand broker get it done correctly or he will be replaced.

    There is a misconception that us brokers have the power. We have zero control. Just a illusion that we do

    How did this end? Did you wait the whole week, or did you deposit the load to a near agent to deliver?

    Here is the story, its Dec 22 and I book a load with JB HUNT to deliver 20 miles away from my house to the GFS distribution center. The broker says appt is next day, DEC 23 at 9, I ask him to change it to 12, he says ok, confirmation comes with 12pm appt.
    I have delivered to GFS before, they are good people, usually in and out within 1.5 hours. Next morning at 9am I call the receiver, saying that due to the road conditions I cant make it on time and will be 1-2 hours late. The lady says that my appt is at 9am, it was never moved to 12pm and earliest she can take me is Jan 2.
    I call the broker, he says it is at 12, since I cant make it at 12, it is my problem now. I can take this load back to the shipper, but they wont pay me anything. I ask him to send me the proof of appt changing, he says his coworker did the change, he is not at work today and some other stuff.
    Call the receiver again, those ladies swear appt was never changed, simply because it was not even possible to do that, they did not have any room to change it and say the JB HUNT is full of #### and its not the first time they mess up the appts.
    Now it gets funny. I call shipper to arrange returning of the load. They said its not their load anymore and I have to figure it out with broker. Calling JB Hunt again, at this point I am so pissed, that I stop caring, call him a liar and ask for the solution. Again, his only solution is to keep it in my trailer and they wont pay anything else except what is on the rate confirmation.
    I start calling around, trying to find a storage, everything is booked, because of the holidays. By some miracle after two hours of calling I find a temperature controlled storage for $50 per day. Call the broker again, offer him the solution, he says they wont pay anything and it has to stay in my trailer. Another problem was that I was carrying cooking oil and on the BOL it said to not let the load freeze. It was supposed to get very cold on 28th, so if even if the load stays in my trailer, it will get damaged, they will file a claim and everybody gonna end up happy except me.
    At this point I decide to lose $500 for storage fees, do my other work after Christmas (worth $4000) and then deliver this load on Jan 2. Got everything figured out and decided to stop at GFS just in case. Got there at 6pm, the second shift comes at 9. Fine, I sit and wait, the night supervisor comes and tells me everything is booked, there is absolutely no room, that I can sleep on the parking lot, but there is no guarantee whatsoever that they can take me.
    I had nothing to lose, since storage was opening at 8am anyways, so I went to sleep and by some miracle they woke me up at 4am and got me unloaded. I just wanted to kiss everybody in that warehouse lol
    Waited till 8am to let know the storage know that I am not coming and then went to sleep. End of story
