Second, do you have a conditions of service also know as a circular? I have one and every single rate con is signed stating that this load is accepted per our conditions of service.

Just today, had an issue with a load for one of my guys. It was a tql load and customer messed up on delivery appt making my driver wait 24 hours to get unloaded. Broker emails saying he got approval for their max layover fee of $250.

I wore back pointing him to look at my accessorial policy for layover, it starts $750 per day. He tried fighting it with me and then tql legal department stepped in saying he had to pay the $750 since the rate con was signed stating reference to my conditions of service.

Not s very happy broker on this one at all, but I was up front with him verbally as well before this load was booked.

I've won this battle a few times with the major broker firms like xpo, tql, chrobinson, coyote, and others.

If you don't have a publisher conditions of service you won't have a leg to stand on.

Seriously take the time as a business owner and understand the rules and laws of this industry and how to protect yourself! There are plenty of resources out there to help you, you just have to read them.

If this wasn't done, then don't expect to get paid.

i can't find anything on " circular " service , some of the rate sheets states detention some dont

Call the bond issuer to verify but I think you’ll find the bond doesn’t cover detention. Only the Linehaul. For this reason I always try to get them to revise the rate con to include the detention in the Linehaul instead of making a separate line item. Doesn’t always work because they know what they’re doing.

I’ve always had better luck getting the revised rate con after l have their freight on my truvk

Some do pay for everything, others don't, we have had out of 10 times 5 who paid and the other 5 said to sue the broker so I did, and won every time.

Biggest thing is what the rate confirmation says, and if they're trying to shortpay the OP, or if they have the detention agreed upon and signed. Needs more information.
