    If you are the one driving, an llc won't do a thing to protect you & it'll mean you have to file tax returns in every state you have nexus...

    Even if the driver is an employee -- who hired him? trained him? dispatched him? maintained his truck? If you did any of the above, that llc won't help...

    If you have personal assets to protect, ask a lawyer about setting up a trust or transferring assets to retirement accounts

    Corporation, but then there is a complication because that only protects your assets from law suits if you manage the company, as a driver, you can be sued too.

    Don't try to hide assets because there is always a way to find them and include them. It is a convoluted world.

    But here is the thing you all need to get passed, the first tool in your kit needs to be a lawyer and use him to determine what you need. The chances are that if you get into an accident, you will see some sort of suit but on the other hand there are bloodsucking lawyers out there who will sue you for everything because it is truck related.

    I ran three trucks as a SP and then after number four I went to a corporation because I got off the road. Since then the advantages have helped lessen the tax liability and helped move it forward. I used a SP becuase no matter what happened because I drove too, I would not win and everything would be up for grabs by a court decision.
