I bought my own car 3 months after obtaining my license.

A person that needs brakes is nothing. The car still stops.

A person that hits your shop because he can't stop. Now we have a problem.

This kid wore his pads completely gone. The pistons wore the rotors down to nothing. And popped out of the calipers.

    What do you do?

There's unsafe. And there's disaster waiting to happen. I draw the line at disaster.

So you would put brakes on the car, with or without their permission, and eat the expense if that's what it took?

I've turned wrenches for over a decade and this was the first time I've heard that a shop can hold an unsafe vehicle. Which leads me to believe its BS.

    Call it what you want.

And BTW. They had the wrecker option.
They didn't have the drive away option.

    Does that clear things up?

You don't have that power. All you can do is require them to sign a waiver informing them that you are not responsible for anything that happens from them leaving without repair.

I think all one would have the authority (and moral obligation) to do if the vehicle is unsafe enough to definitely cause a wreck would be to contact the police/DOT and let them handle it.

Just FYI in the USA, NO mechanic has the right to keep your car no matter how unsafe. Look it up.....
