I met two drivers in MD pulling shingles out of MA who said they operated like o/o's while driving another guy's trucks.

They picked their freight and were paid 50% of what the truck made minus 50% of fuel cost.

They were driving another guys trucks and were telling me how to save on fuel!! They also took off when they wanted.

    That's job ownership.

Yes, they are in control of that truck within the guidelines and policies of the company. They are hired to fill the needs of the customer who is the broker or the carrier the truck is leased to.

By the way zvar, the IRS said it was ok, they audit me almost every year because they like me that much.

I was just offered a 1099 position and the owner said I could make up to $2000 a week with $1500 on low end. I was told they would pay workman's comp. I would just owe taxes minus whatever credits I claim such as per diem?
    I am confused?
I have not seen a post on what Legal 1099 pay plans are exactly.

Unless you own the truck and pick the loads you should never work on a 1099.
