    my question is who drives in winter without proper sleeping equipment and attire for just in case situations?

    Actually your job is to be legal, which unless you were logging all that time, including waiting, as on duty you weren't.
    Don't be going and trying to make yourself the victim when you weren't even being legal.

    On-duty time means all time from the time a driver begins to work or is required to be in readiness to work until the time the driver is relieved from work and all responsibility for performing work. On-duty time shall include:
    (6) All time repairing, obtaining assistance, or remaining in attendance upon a disabled commercial motor vehicle;

    Not all megas pay there bills or on time. The service I used to manage kept a list of COD fleets. You would be surprised how many big companies were on it. The company I worked for was established 1927, the list was very long. Included grudges and insurance companies that short changed them to.

    as a company driver you are the first line of representation for your company. whether you see it like that or not. it is the case. the mechanic did his job and your company failed to pay him. as a representative of your company you are the person he was dealing with first hand. so your job at that moment in time does not involve sleep . it requires you to solve the problem at hand. you chose to deal with it later along with disrespecting a mechanic doing his job correctly and even being nice enough to give you time to figure it out, but you chose to sleep instead... it is so ignorant to think that a mechanic will come fix your truck and you can pay them later. would you like to do business with someone that says "yeah go ahead do your job, then when you're done ill promise ill pay you tmrw" yeah #### you pay me. theres 2 people you never wanna disrespect. the people who feed you and the people who fix your ####.

    I'm trying to imagine the service guy sitting there in his truck waiting until morning for payment. Im really trying my best to make sense of it

    thats not how the service business works at all. and also this transaction is not a business transacting with another business. you are a customer when you are broke down and they have the parts to fix you. you're company schmuck shouldve gotton a quote beforehand and its a pretty reasonable thought to come up with "no quote, no business" thats pretty standard when dealing with shops... the guy is charging you by the hour to sit by your bedside while you chose to sleep instead of dealing with the problem . thats why his rate goes up. its the same concept as detention time for trucking companies. actually its the reason why shops hate dealing with trucks and truck drivers because of people like you and your company

    There was no extortion. You might want to look up the meaning. He was simply going to make sure that the equipment didn't leave before payment for service was rendered. Just like a computer shop won't give you back your computer. Before you pay for the repairs.

    Imagine you go to Walmart and your card is declined. Think they are going to let you walk out with the big screen TV. Nope.

    You wanted sympathy. Cuz the big bad mechanic might have you sleep in cold weather. But reality kicked in instead.

    If you're dumb enough not to carry a cold weather kit on the truck. You deserve to freeze. Because you never know when you are going to break down and if you are going to have cell service. Who you going to blame then?
