I bought my truck in late November 2008 and leased it on to Landstar. I filled out a bunch of papers for the deal and for Landstar. I did everything I was supposed to, I thought. Paid HVUT before the end of the year; I got the Illinois tag. The vehicle is financed, of course, and they have the title.

The dealer called me the other day and said that I never filled out an application for the title. Apparently, they forgot to give me this paperwork or whatever.

What state do I title the vehicle in?

My home state - SC ... or
The state where I bought the truck - NC ... or
Or the state where I have the tag - IL ???

    HELP

If I title the truck in SC, my home state, I will have to pay a title application fee and sales tax, but do I have to pay property tax or is this just for personal vehicles. Are my taxes covered by the IRP????

Can I legally title the truck in Illinois???

    HELP

Who did ya get the Illinois plate from...Landstar? If so you are basically running Landstar's plates. As for the title you need to have it done in the state you live in, same as a car. As for the taxes I would check this out with your local title office cause someone dropped the ball at the dealership or finance company.

The finance company is the legal owner. Therefore, the title is their responsibility until you pay off or resell the truck. I would make sure that the title application is forwarded from the dealer to your lender so that there are no problems down the road when you take legal possession. It is not necessary to apply for a new title at that time, As long as the lender signs the Lienholder Release box (after you make the last payment).

You can title the truck in any state providied you have a physical address in that state. One thing to keep in mind is that as long as you have the previous title with the Lienholder Release box signed, it is just as good as a new title from your home state showing you as the legal owner.

I'm not familiar with SC taxes and fees. General rule is if you buy a truck and lease to an out of state carrier, the fees are waived as long as you can prove that you drove the truck under a motor carrier's IRP for a minimium of 6 months. Don't take my word on that, however. You should be able to find that information on the South Carolina .gov website.
