Where in the FMCSA regulations do it say about drivers being stopped without reason?

    Per my understanding the only time they can’t just randomly do an inspection, is if you were in the sleeper berth. They’re not allowed to wake you up. Everything else is fair game.

    I saw a trooper just the other day at a rest stop pull up behind three trucks, turn his lights on and proceed to do an inspection. He stopped one truck before he got to me.

    If a driver is legally and safely parked almost all cops will leave a sleeping driver alone out of courtesy! I am sure you would want a cop to wake you up if your truck was on fire? Cops will also wake a driver up if they have probable cause to believe you are engaging in human trafficking or have a minor child that is NOT yours in the truck. A Virginia driver was recently busted for having an underage person with him. Cops are really watching for this like a hawk!

    This is why I treat these topics like I do. A cop wants to see your sleeper and articulates probable cause you have two basic options. Comply or be arrested.

    Also nothing says they're not allowed to wake you up. It's only a guidance.

    Thank you for this. This answers the question that I posed a while back in another thread wondering about the legal justification for stopping a CMV (in the absence of reasonable suspicion) in order to conduct an inspection.
