Who's fault was it?

    i dont blame the driver from a "legal" perspective, the first two cars were clearly at fault

    but from a "common sense" perspective, he should have not allowed the first car to come in, and he should have seen the second car was on its way

    and lastly, the first car (who probably got away) was the actual cause of the accident, and really bears full blame, because he deliberately caused the chain reaction

    this is why "the front bumper bears the blame" rule does not always apply

    You don't know that motorist applied the brakes for a "brake check". They might have reacted due to looking at the speedo, or their radar detector might have lit, ad infinitum.

    The truck driver shares a great deal of fault. When the first car was passing he should have assumed it would be moving to his front and backed off the throttle. He didn't.

    When the first car exhibited the intention to move L by signaling he should have backed off the throttle. He didn't.

    When the first car moved to his front he should have backed off the throttle. He didn't.

    When the second car was passing he should have assumed it would also be moving to his front and backed off the throttle. He didn't.

    Pretty clear-cut case of the easily avoidable "crash".

    The least funny thing about "driving" is those who are worst at it tend to think they're best at it. This nitwit should not possess a CDL.

    Truck driver did nothing wrong. I wouldn't back off the throttle either. #### the four wheelers. :)

    We pay more in fuel taxes so we do own the road.

    Watch the lead truck, he is braking, for what reason, can not be seen in the video....

    Exactly the same way you don't know if he was looking at his speed or radar detector. But more than likely, the 4 wheeler wasn't speeding excessively and it was a brake check. He hit the brakes after he merged into the other lane causing the other idiot to brake suddenly after or in the midst of cutting him off. I mean cmon, he just had to hit the brakes right after he switched lanes,? yea I bet he was watching his speed or bears alright....Just look at the beautiful comments on liveleak..

    Unbelievable some of the comments here, blaming the truck driver for doing nothing wrong. Did anyone else notice that the second 4 wheeler crossed in front of the truck so close that you never see the tail lights, hits the brakes, losses control of their vehicle, THEN gets impacted by the truck??? So the truck is in the left lane, no one knows why or for how long other than those involved in the incident, yet so many pass judgment. Truck drivers blaming another truck driver when there is NOTHING on that short video that is damning to any other but the 4 wheelers shooting a gap between an overtaking semi and a braking semi.

    From this short vid we can't by no means say why he slide left in the first place.
    I can not pretend to count the times i slide over to let traffic on and they sit there for a little bit then speed up to pass. Next he said he needes the left for his exit so he stayed there third the first 4 wheeler slide over way to close as they where coming up on the truck on the right and second car was over so close that we never had a chance to see tail lights.
    I see one getting that starts coming over(till then not slowing for impatient fools) jakes on but i wont slam the breaks and cause a wreck behind me either way he was legal from the little we saw. And i hear so many say that any rearend is the fault of the one at the rear false (in most states) if you can prove they did not have full control of the lane for atleast 3 seconds.

    Preventable all the way. If he was at home and on welfare instead of providing for his family this would have never happened.

    Wow ..... 4 wheelers at fault as well as Truck Driver.
    As a professional Truck Driver, you should be watching your mirrors to prevent exactly what happened in this video. I cannot believe some of the reponses here, you see those cars coming in your mirrors and back off. So it takes another minute to get around that other truck big deal ! ...... you may just save somebody's life by not being a ignorant or stubborn driver ..... geez. I gotta think the lawyers are gonna have a field day with that video, you cleary see those cars coming in that right hand mirror.

    Monday morning quarterbacking is easy.

    I have 4 wheeler do this to me frequently ( climbing Tehachapi out of Bakersfield) They do not like trucks in the left lane, If I'm moving the speed limit CHP does not have a problem with me out in the left lane passing slow trucks , I actually have ask them about this because they are ticket happy in that area.

    There are a few of the four wheeler that will pass you on the right them slowdown to almost a stop, then take off. They come up on you so fast and follow so close you do not eve know there there till they cut you off. After I pass I get back to the right .

    In the video case I believe that the driver could have prevented it, when the first car pulled in I would have backed off , Most driver have been there done that.

    Bottom line the truck is not at fault for causing the accident, but was a contributing factor for not preventing as far as legal standpoints.
