Who's fault was it?

IMO, fault is a combination of the truck driver, and both vehicles, starts with the truck driver, he shouldn't have been in that lane until he got a little closer to traffic in right lane, then secondly, the first car to pass on the right, no need for the break check, last but not least, the second car to try and squeeze in, again? JMO
