of course i was not forced to drive drunk
i had not seen him in the casino for over 5 hours then he says i have to leave right now i told him that i shouldnt drive he said he is gonna loose his job if we dont leave right now i should of said i am drunk i cant drive
the last drink i had didnt hit me until after i got in the car
he should of not let me drive instead he wanted me to drive
i was not gonna let him drive my car because he wrecks everything
still yall are right I could of said no this is my fault its just that i had someone telling me to drive or they would get fired otherhalfwt says that i only care about myself if that was true than i would still have my cdl becuase i would of told him i cant drive -

Let me try to explain my true, deep seated anger to those who drive while under the influence.
I was once with a fire department in Northern CA, in this position, there were too many times I had to cut a vehicle apart to get the victims of DUI offenders from those vehicles, sometimes not alive.
I also worked, with a local funeral home, this is where my careers were capped. One night, the father of 3 young daughters, (2-5-9) with his wife in the car. Both mom and dad had to have ####tails after work on the way to picking up their children from day care. The roads here in El Dorado county are basically old wagon roads, built around trees, winding roads, most of the trees are very old, very large oak, and we all know oak tree vs. car...tree wins.
This evening, the tree won again. I had to be on call with the Funeral Home, was called to the scene for the removal. It took firefighters 3 hours to cut the car away from the tree, another 1.5 hrs to get the girls from the vehicle...who didn't get hurt...drunk mom and dad, the air bags saved their lives, no seat belts, no car seat...does the fact that mom and dad will be doing 20 yrs for vehicular manslaughter make me feel better...NO WAY...will I be there with pictures of the vehicle when these two come up for parole in two years...you #### right I will, and I will be saying and doing everything in my power to make sure they do their full 20.
Any driver with a CDL who gets a DUI in my mind, should never drive a rig ever again...NEVER...when you got your license you accepted the responsibility, you knew the rules, you are supposed to be a professional...so act like one, no matter if you are behind the wheel of a 4 wheel vehicle or 18 wheels. If you need to drink...stay home and drink responsibly...better yet, if you got a CDL and that is your livelihood...leave the booze alone altogether...I do, I will, and I won't lose my anger to those who drink and drive..and I will report you if I see you doing it..no problem with that!ironpony, kickin chicken, PAJ1979 and 1 other person Thank this. -
I don't think he'll drive for quite a while otherhalf. In his other post under trucker legal advice he stated that he was charged with DUI but the attorney plea bargained it to Reckless. It was in Louisiana & he lives in TX. But he also refused the breathalizer & now his license is suspended in TX for the TX implied consent laws. This plus a reckless just about puts the kaboshes on his driving for a while. And apparently he doesn't understand implied consent either.

PSANDERSON,I think you or I answered this guys question in truckers legal advice.He said reckless,I said wet reckless.I believe he would have to have to two reckless for a 60 day disqualification for CDL.Wet reckless,harsher penalities.Refusal to test,1 year.Not disclosing past violations to your employer or your employer not doing a background check.Fines and jail time.Coolcbhandle,don't even go near a CMV for now.Your on probation,you screwed up once,don't be so quick to screw up again.High priced lawyer or not,you won't be driving for awhile.You wanted some positive advice,no one on this board can give you any.Last thing.What is so hard about taking a cab home after getting drunk.It might cost a few dollars but look what it's costing you now.

i also said that my state capital made a mistake disqualifing my cdl for a test refusal
and they have recalled the disqualification after a letter from the lake charles louisiana distric attorney that explained they lost the refusal hearing because the cop didnt show up
but the first letter from my capital made me look for other work than commercial driving, i did get worried that they were not gonna recall it
and in the mean time i got a full time job at my old profession being of a topless club dj
not to worried about my reckless it will stop me from getting a job at most places but not all if you are determined -
i remember asking the lawyer specifcaly if the espongment will wipe it off my criminal and driving record and what he told me is...
"once it is off your criminal record than it is gone"
if there is a federal law passed in 2005 for non cdl espongment it will not effect my reckless being a defered ajudacted probation under artical 893
i am thinking that the lawyer knows what he is talking about, he is a lawyer

500 court fees
1,000 for lawyer to esponge
that brings the total to 4,000
4 grand and have reckless on my mvr for 1 year that is what the dui cost me
yall are all so sure that i have killed my cdl for 5 years and tarnished it forever, but most people probably dont spend 4,000 to fight and stop that from happening
guys dont hate me, and try to tell me hang up the keys i have paid alot and learned my lesson i will never drink and drive again and have done everthing possable to correct my mistake as if it never happend and that is how its gonna appear as if it never happened, you guys are not attorney'sLast edited: May 24, 2009
