    Nobody hates ya dude! You've got an expensive lesson here. The problem is, that wreckless driving beef will be on your MVR for 5 years. If anybody hires you with a documented history of wreckless driving, and then you get in an accident in a CMV, their business is toast. The accident liability lawyers will have a field day with them, and the simple answer is that the company's insurance won't cover you.

    It can remain on his MVR for 7-years under the federal Fair Credit Reporting Act. I hope he keeps in contact in this forum to see when he gets another driving job, assuming he gets one. And yes, if the implied consent was dismissed because the officer didn't show up it will not be on your MVR because legally it didn't happen. But the reckless can't be expunged as the federal rule over rides the state law therefore your attorney is wrong in this instance. How do I know this? Well, I had a part in writing that rule/law. One thing is for sure though; you're not driving your dump truck now making $500 a day are you?

    With the number of drivers looking for work in the driving industry, the question should be, " Will any one hire me even though I have a perfect driving record? " There are a lot of good drivers with good records that are being turned down. So, the more marks against someone, the less chance for a good driving job.

    i sold the truck after the dui because i got too low on cash, yes it was because of the dui and the lawyer i had to sell my truck to survive

    i have got enough to get started if i wanted to finance one but i dont think im gonna take a huge risk like that and take a chance on loosing everything

    just gonna have to save up slowly maybe save 20 grand in a year or longer and go back to work for the guy a bought my first truck from, he doesnt care about my reckless

    i could work for him now but i am not ready to buy a truck from him so i am just trying to save a little money doing something else until the day when i can try to own my own busines again

    its sucks that i lost it, but i know i did it once and i can do it again, just no more drinking next time

    and if the reckless stays on my mvr then instead of me paying 300 a month for the dot half a million dollars of coverage for commercial insurance i will have to pay 600 a month

    its not impossable for me to be a owner operater again, it just doubles my insurane prices

    so maybe one day

    what is your point

    is everyone one on this site a hater or just in a click and talks negative to everyone thats not part of it or is everyone tired of seeing these kinds of threads

    this members of this site seem to all be wrong and give wrong answers and wrong leagal advice while claiming it to know the, law as far as my reckless being off my record in a year you people never even consider the possabillity that my attorney was not lying when he told me it will disapear off my driving record after 1 year because it is under artical 893

    this site is about trucking and has people just babling about incorectly about laws or anything to make a noob who shows up feel less than they are

    i bet some of you feel that if you have 4,000 post then that makes you an expert on everything on this site, that is what is wrong with forums man, you got people that whos goal in life is to build up their reputation on sites like this one and pretend to be some kind of profit

    The provisions of the Code of Criminal Procedures (Articles 691, 892.1, 893 and 894) cannot be applied to any conviction that would result in a disqualification or in a subsequent disqualification. This includes 'Serious Offenses,' 'Railroad Offenses,' 'Out-of-Service Offenses' and 'Major Offenses' as specified in this policy. These convictions are added to the driving record as guilty convictions and become a part of the driving record. Any required disqualification remains in effect for the duration of the disqualification period and the reinstatement fee is collected.

    When a Refusal or Submit results in a disqualification, the disqualification for the Refusal or Submit remains in effect for the duration of the disqualification period and the reinstatement fee is collected, regardless of the disposition of the DWI. Act 605 is not applied to the disqualification of the Refusal or Submit resulting from the same occurrence.

    ARTICLE 894 - CODE OF CRIMINAL PROCEDURE
    The provisions of the Code of Criminal Procedure do not apply to CMV violations/convictions.

    Expunging Louisiana Felonies and Other Serious Misdemeanors, Article 893
    In the state of Louisiana, certain misdemeanors must undergo the expunging process used for felony arrests. These misdemeanor charges include:

    • Battery of a Police Officer; 14:34.2
    These offenses, coupled with all other felonies, can be subject to expunging after a period of time lapses between the arrest and request for expunge Louisiana arrest records. Additionally, felonies and the aforementioned misdemeanor arrests require a hearing with the state of Louisiana District Attorney, as well as the presentation of contradictory statements to the expunging motions from arresting law organizations. With expunging of felonies and these misdemeanors, the records will be restricted from public access; however, law enforcement is not expressly required to destroy all records relating to the arrest.
    Louisiana state laws provide for the expunging of felonies, whether occurring in Orleans Parish, Jefferson Parish, or anywhere in the state of Louisiana, under the provisions of Article 893. Article 893 of Louisiana law pertains to the ability of individuals to acquire expungement of their criminal convictions with the counsel and representation of an attorney.     IMO:"COOL" When you post your issue/story on a forum you are opening the door for anyone to make a comment. You made a HUGE mistake and a not so smart one either so if your gonna post it you have to beable to deal with the responses you get. Any advice/info given of course should be double checked and taken or not...thats up to you.

    CALLING POSTERS IGNORANT IS NOT ALLOWED, nor is anyother form of insult. There are rules here for this!
