workers comp for owner operator in New Jersey

    Hello,
    I have a question. I am a owner operator truck driver and I have a workers compensation. I worked for a company for couple days and now they don't want to pay me the days I worked for them. Their allegation is that they needed to pay worker's compensation for me, but I have my own. I worked with other companies and I did not have that problem before. Can you help me with any information about it? Thanks.

    So you pulled loads for them, and now they won't pay b/c of workmans comp?

    Something sounds a little fishy. If your a o/o, then why would they pay you as an employee?

    How long ago did you complete the loads, and how do you bill them?

    If you're an owner op, you're an independent contractor and you do not get workman's comp.

    However, if you really are independent, you could form a C or possibly S corporation, and add yourself as an employee of the corporation, then you would have to get and pay for workman's comp insurance, which isn't cheap. You'd (the corporation) also have to pay employment taxes on yourself, issue yourself a W-2, etc. And you'd have to pay corporate taxes on the profit and also typical income and ss/Medicare taxes on your personal taxable income. And then you might be eligible for getting workman's comp if you're hurt.

    But as an independent contractor, you'd be better off getting your own occupational accident insurance.
