Workers Comp Insurance

    I am an owner/operator in Calif. , I am contemplating signing on with a local company. Is it legal for them to ask that I pay for workers comp if I don't intend to hire employees?

    If your leasing on.... I believe the answer is yes it is legal....

    They can't tell you that you have to buy it from them......you have the option to buy your own from whoever you want to.

    But I'm no contract lawyer..

    It varies by state. Not sure about CA but in NY if your leased to a company doing only work for that company and nothing on your own, you are still considered an employee of that company and not an independent contractor as far as workers comp goes.

    I'm guessing OCAC. Never heard of companies requiring an O/O to get workers comp.

    I deal with companies that want workers comp and im solo. In OK you file paperwork with state proving exempt and they give you form to satisfy the companies.

    And if you get hurt...?

    Exempt means someone gets stuck with the bill ....

    Exempt means the O/O pays his/her own medical bills.

    I know that a NY state workman's comp policy based on 35k/yr earnings which is the minimum you can show according to them runs close to $9k/yr premium through the state insurance fund. How ridiculous is that.
