Just curious to see if I can get any input from you guys on my situation. I got hurt on the job first of July...been with the company almost a year. I'm currently drawing worker's comp...I have a shoulder injury. My question is in general once you get better do you go back to your job or are you "let go" for some reason. I know that they can't really fire you for getting hurt on the job but do they usually come up with a reason to get rid of you. I'd prefer just to go back to my dedicated run and be home every night. But, everyone I talk with says that most of the time your let go once you come back if you didn't try to get a settlement from them. I'm not sure if I should just try to get a lawyer to get a settlement and hunt another job or what. Anyone got any advice about this? I'm stumped...I've never filed a workers comp claim before and all of this is new terrority for me.

I have been on workers comp 2X with my company. 1st time for a torn knee and then for a ruptured Bi-ceps Tendon. I have been with this company for 15 years and never heard of any driver let go after returning from workers comp. If your injury was legit and you were off as long as the company's doctor wants you off and then you return with no restrictions, why would they terminate you? we have drivers getting hurt from loading/unloading LTL all the time and from slipping and falling on the ice. worker injuries are pretty much expected in this field.

If they,
1. fire you when you come back
2. make life so miserable at work that you want to quit when you come back
3. if you think you will have life long problems related to the injury
then call an Lawyer.
If you
1. think you your gonna get rich (like over $2000.00)
2. hire an attorney, get a settlement, and think your old job will be just like it was before,
then don't get a Lawyer, you'll be sadly dissapointed.

Last year I got sick while driving, Company was nicey nice to me while on medical leave, untill a week before i was able to go back they fired me.right at vacation and bonus time. never gave them any other reason to fire me. and companys can get away with it. I been unemployeed since cause no one will hire me.

6 months after my return to work i rec. a check for $3600.00 from our workers comp. ins.carrier. I thought it was a mistaken overpayment. turns out the doctor put me in for a % of permanent damage to my knee. i wasnt excpecting it but it came in handy, meanwhile the knee feels great 2 years later.lego1970 Thanks this. -
Same here, I broke my leg and tore up my shoulder in a tree accident a couple years ago. I never asked for a settlement, but got back around $3000.00 a year later. Took my son to go see the Grand Canyon, Hoover Dam, Las Vegas, and a few other tourist type places. Was the injury worth $3000.00? Heck no, you couldn't pay me enough to go thru that pain again, but it was an accident, a few issues but for the most part I was treated pretty good, and got a nice vacation out of the deal. Today, my leg is almost 100%. When I sqaut my left knee sits about 4" higher then my right knee, and when I get up from the ground I have to roll to right side and let the right leg do most of the work, however I have no pins, I can jump, jog, climb trees, or doing anything else that I did before. What I like is during that time I don't know how many people came to me saying that "your looking at $30,000...50,000...or even $150,000 for an injury like that". Sure with a Lawyer, I might of gotten more, but from what I've heard from another Attorney friend of the family, it wouldn't of been much more, plus I probably wouldn't of been well liked when I returned to work, so I guess what I'm saying to the OP is if he's getting jacked around at work or from the workers comp insurance company, hire an attorney, but if it's a get some cash so he can go buy a car thing, and start work elsewhere then don't bother. He'll only be sadly dissapointed, plus drive up the insurance rates for everybody else.Marksteven Thanks this. -
I just want to go back to my original job. I could care less about getting any money. I just want my shoulder to get better so I can go back to work. But, I'm just worried that as soon as I get better and go back to work they will find a way to get rid of me.
