They didn't have to write you up. They could have given a written warning instead of dinging your employment record. Technically, even Line 1 doesn't cut it because you're still on duty. You're on call. Accidents like this are a prime example. If you were truly off duty you should have ignored ANYTHING work related until you logged back into Line 4.

When you're off duty, you're off duty. You're not expected to do anything work related. However, if you're on your 10 you're technically on call since you may have to do work related tasks at any given moment such as dealing with accident reports and paperwork.

The entire HOS is Orwellian at it's core. It's sole purpose is further enslavement of mankind. After the speed limiter law, they'll be putting tearless retinas in the trucks make sure you are in the berth when logged as such.. Mark my words, it's coming.

What's the difference between an employer "writing you up" and "giving you a written warning"?

Dang so many cry babies. How hard is it to log it like you do it? Plus complaining that the company is in the wrong. When the OP is the one that logged it illegal.

Never had a problem. Pull in. Log off duty. Head in for food and shower. Back in the truck. Log sleeper. Get up. Log off duty. Head in for coffee and toilet. Only time not logged off duty. Is that time you go to the restroom in the middle of the night. It's not necessary.

If your truck gets stolen or burns to the ground while you're away from it and you're logged in sleeper that may present some problems down the line.

Those big companies or small companies, but especially the big ones, those safety people have to justify their existence.

Same as the dude's working the coups.

Every company I've ever worked for with a formal discipline policy it's exactly the same thing. Every company without one it's up to the mood of the manager that day.

So again, what is the difference in your world?
