this might be a stupid question but i'm getting conflicting answers so i'll ask here, and if I asked this in the wrong category i'm sure the admins will move it (thanks in advance)
when you take the break can you do it on Lines 1 and/or 2?
this guy is saying it can ONLY be done on line 1 (a Caltrans DOT officer told him)
he also says when Hauling a HazMat load you cannot ever go on line 1 (which is true to a point)
I know i'm right but he says i'm not, who's right and who's wrong.
again, I know this is a stupid question and i'm sorry

You can use line one and two. They are both OFF duty.
Technically, if you're in the sleeper for ya 30 min break you would log line two..

You most certainly can log on Line 1 Off Duty while hauling a hazmat load, even one that contains Division 1.1, 1.2, or 1.3 explosive materials that requires the driver (or qualified representative of the motor carrier) to be in attendance of the vehicle at all times under §397.5. Mandatory "in attendance" time may be included in your break time if no other duties are performed. A driver can sit in the driver's seat of a legally parked CMV and log Line 1 Off Duty any time he/she chooses provided no other duties are performed, hauling hazmat or non-hazmat.
Jabber1990, not a stupid question. I am amazed at how many law enforcement officials a year after the 30 minute rest break requirement became effective still fail to realize that time spent in a sleeper berth is OFF DUTY!crb, otherhalftw and 48Packard Thank this. -

The guy didn't seem all that bright
we had to do a re-power (we both went home) we were told to agree on a place to meet, he was unware of any places to stop and meet, he threw his truck stop book away since he had a GPS
just a few breaths later he said he doesn't like being told where to fuel, he's tired of the company yelling at him for being out of route, he doesn't like how the company at any time knows where he is.
so, you aren't smart enough to think for yourself but get mad when others think for you?
he tried to get me to drive further to go to a truck stop that I dont even think exists
when we met up he did the supertrucker stunt of parking his bobtail right next to his trailer. then he yelled at me for not parking there, in order to back there I would have had to blind-side, or I could have parked 5 spots away where there were 4 open spots and I could have sight-sided in
