yes, if one lives in a "3 strikes and you're out", state law

the overall background, past transgressions, arrests, convictions, etc.....

your way of thinking then, is if a CDL driver gets caught several times, he needs to be released cuz he didn't mean to do it..????

BS, use thier past to punish them into oblivion.

No my point is all punishments should be the same. So if one was to have a wreck and kill someone they would do 10 years or whatever the law would determine regardless of past unless the exact same crime. Then punishment should be doubled or whatever they decided.

What I hate about our system is they will hit some people with Max sentence and others with probation. Lot's of times like myself they give ungodly sentences to first time offenders because of the family name/or a personal issue with someone.

My brother got a 30 year sentence for 2nd degree murder and is gonna do almost 95 percent of his time. He was suppose to do 85 percent but got a later date for some reason. He has not had a write up in prison and has had one of the tops jobs in there most his bit. I never met anyone while I was in that did not get a write up so that is saying something for being in for 25 years.

I seen lots of 1st and 2nd Degree Murder Charges do less time than him and considering how weak his case was he should not had even been convicted. But because of our family name they hung him for anything that would stick, First Degree got dropped once he bonded out they decided to bring up second degree so they could arrest him again. The system as is is rigged beyond belief.

Even worse than all that is how they let child predators do less time than almost any crime. I have seen so many that should had been locked away for ever and given 2-10 years max.

If you do the crime, you should do the time. We need to stop all forms of early release, set minimum terms and go back to 3 strikes your out. The prison population will rise but crime will drop. This is a proven fact that we seem to have forgotten.
