    Since it is the responsibility of ALL drivers, to not allow their vehicle to make unwanted contact with any object, it is the primary fault of the hitter. No matter how much the hittee may have been wrong.

    I vote Swift.
    This is why you back into parking spots, the sun, reefer noise and being afraid of getting your hood tore off is all bologna.
    .
    Swift chose to park in a spot where they had to back out blind, not being able to see hardly anything, plus Swift had a set of extra eyes that should have been outside watching.

    [in Larry the Cable Guy tone] You know what pisses me off? What pisses me off is when somebody is backing slowly with 4-ways on, and other traffic in the lane keeps proceeding right in behind them because they claim to have the "right of way" and don't have time to wait 20 seconds.

    There is that.

    I thought about that carefully but still Swift is backing and he touched someone while backing... he loses.

    Wow imagine that, a Swift truck who can't back into a spot for a 10 hour break and then can't back out without tearing something when its time to hit the road and work. Pitiful :laughing-guffaw:

    I watched that tonight, actually. Roehl driver was trying to back into his spot, and I counted no less than four trucks that just flew behind him.
