You can't refuse a DOT inspection but...

    Yeah, he did. Went back inside pointing fingers and using foul language in front of other people. The customs guy threatened to arrest me and I got louder. The supervisor heard the commotion and came out and he asked me what was wrong. He then gave me the info I needed to file a complaint. And I did file a complaint.

    I crossed over at North Portal a thousand more times and never had a problem there again or anywhere else for that matter.

    I had a friend that was a driver, he would always burn his receipts and any paper he didn't want.
    I had concerns for his safety because he was burning in his truck.
    He refused to just throw it away.

    He said an officer in a rest area searched the trash for evidence of log violations. He got put OOS

    This was 15+ years ago. I wonder if he still does it.

    Easier to burn with the ELD. Hahahaha

    Here is part 1 of a video of a driver refusing to help the DOT officer do an inspection. It’s tough to watch due to the video stability, but he had some success. On the flip side, when I was a cop, a good attitude went a lot further with me and usually ended up with just a verbal warning. Instant attitude? Well you might as well have handed me an ink pen.

    I'm not an attorney, but I think you'd have a hard time making that stick in court - assuming you were able to get back to that jurisdiction on the court date. But if the officer turned around and charged with obstruction or retaliation I guess you would have no choice to return to that jurisdiction for your court date.

    In my state (Texas), a citizen is not authorized to make an arrest unless the offense occurs in his presence or within his View, and the offense is a felony or breach of the public peace. And the amount of personal possessions you would have in your truck is unlikely to be enough to qualify as a state jail felony.

    I would think trying to do a citizens arrest of a cop would end up you getting arrested with obstruction of a police officer

    If you are in a rest area on your break and they start going down the lines inspecting while you are on break of 10 hrs. and they demand you comply, what are you supposed to do? Legal wise as soon as you talk to them you should be on line 4. Just stick the pillow over the head and snore and ignore?

    It's pretty #### simple. You drive a truck, they can inspect it any #### time they want too. Let them. Don't trash them, they probably won't trash you.

    That funny as hell; but raises a good point! If your out of hours and you let them inspect you could get a violation?

    If you are not successful with snore and ignore, you will have one choice. Be inspected, start a new 10 hr break, and reschedule the load if needed. Since you can work past 14 hrs, just not drive, he is not requiring you to do anything illegal. It sucks, and isnt right but it is what it is. A rest area is concidered a portion of the public roadway, and we are subject to inspection anytime we are on a public roadway. Now, on private property, you may have more luck telling him to go away.
