Your are correct , between having the oos statue stuck in my head and my companies policy of having to have available hrs. to use PC I quoted incorrectly.

Correct , I went back again today and could only find the somewhat vague guidance.

The important thing is to send messages as these events happen, not after the fact. Don't do it hours after the fact. God forbid you are in a wreck over hours, a judge or jury may be more lenient.Last edited: Oct 24, 2017

Your are wrong and correct so was I.
You can use PC after your 14 has expired but you can't drag an empty trailer and use PC , DOT considers and empty trailer as a laden vehicle.
When I posted I had the oos statute and my co. policy of having to have available hr. to use PC stuck in my head.
So technically that was an illegal move.
Posting this after a few calls to DOT.

Fmcsa will need to put a guidance in the regulations. It does not specifically state if an empty trailer makes the cmv laden.
I suspect you just got that officers interpretation. If you care to be thorough, you should call multiple scale houses from multiple jurisdictions and report back your findings.

That's what I did.
In addition to that I have one that will be in a conference call today with FMCSA and will ask specifically about leaving a customers property with an empty trailer.
But again the rest have stated that with an empty trailer you will be cited. -
Matter of fact my first call was directly to FMCSA but when you hit the closest menu promt you get mesgage to contact your local DOT office. Couldn't get a human to answer at FMCSA. Lol

Can you ask them if it is in the regulations? It appears unclear as it only says "unladen". Which to me means it is up for interpretation.
