Your experience with violating HOS.

    There could be situations in which you knowingly decide to violate the HOS and the reasons are plentiful, good and bad. Let's not talk about falsifying.The immediate consequence is that they will put you OOS at a weight station while the violation is taking place and most likely fine you. But I am more interested in how this is dealt with, if there is a discovery done a few days after the fact. So far, they would mark it on a DOT report and rarely fine you, unless it was something really audacious, like 3-4 hours over. So what have been the consequences for you for getting caught two days after fact when it shows that you went over 2 hours over 11, rested 1 hour too short, forgot about 0.5 hour break or similar. A warning? A fine? A verbal reprimand?

    We have a macro to complete following any HOS violations detailing the reason.

    I went 90 minutes over the 14 because 90 had been closed over Snoqualamie on a busy Sunday afternoon due to snow, and once opened it took about 4 hours to drive 60 miles to the nearest truck stop because of stop and go traffic the entire 60 miles. Nothing was said.

    You knowingly violate HOS, you also falsify.

    If you did not violate, you did not falsify. And there is no problem.

    Any violation detected in addition to other charges such as vehicular manslaughter etc work against you. This is not something you get a slap on the wrist for. You get a giant sticker on your windshield and you are OOS right there at that spot unable to turn a wheel lawfully. Making you late for appt and possibly fired for it. Fines are assessed against you for which you have to pay. If you fail to, then you face the possibility of a bench warrant.

    Forgetting is not a defense in driving laws. You can bleat all you want to that you forgot. There is only prosecution against you for a violation.

    Ive done both sides in my life time, there is nothing left to go over or discuss.

    At the end of the day the HOS is there to protect you. You already are working 70 hours, If you cannot run across the USA in one trip in that 70 hours period by yourself then you should not be in trucking.

    Idk man. Nothing has ever happened to me. Paper logs, we’ll see once eld happens how it all goes.

    That’s the issue HOS not the Eld the Eld required to hook up to the ECM is a cause for concern. Choice to invest in a machine that one company may use ie.. ppl net, the IC purchased a Qualcomm etc. So when the truck move to a new company that uses a different setup the Owner has to buy a new Eld. The hours of service will always be violated the only way to stop it will be to pay good wages and stop the rat race of drivers worries about all the miles they can get in a day. I also will add to this Trucking should add a longer training and education requirement. Trucking may soon become regional for most. This industry needs to reform,training,Hos,and education requirements.

    All HOS comes down to is PAY. They were and are bad Drivers and Companies that don’t know when to stop and allow rest. Thanks to the scum that did the favor of running illegally. We get eld to ensure the accuracy of our hours.

    You can not plan for what happens on these roads anymore, with the crowding of the roads, accidents that shut down a road for hours, No one should be forced to pull on a onramp to do a 10 hr. break because then you hanging yourself out who knows where for what? Also some of these recievers that take over 2 hours to unload you are setting you up for a liability that should not be forced on truckers, those recievers that do that should be forced to provide parking for trucks along with a clean bathroom and shower so they can take a 10 hour break. Oh then a meal.

    I've gone through a handful of inspections while having a few minor hos violations since going on elogs. All that happened was the officer asked me to go into more detail to explain the short note i typed into the comments section. That was it, no tickets, no written warnings with csa points. They aren't looking to bust your ### over a minor life happens event, they are looking to put a stop to flagrant disregard of hos regs.

    However i don't think cutting a 10 hour break short will go over very well, that isn't a life happens event.
