I hope the driver did not put his hands on that guard, because if everything is accurate he is toast

My husband and I arrived at Metro Logics, 10635 Marina Drive, Olive Branch, Mississippi at 0745 on 11, September 2018 to a closed security gate with a guard shack to the left of the driver's side of the truck. The guard asks my husband where we're coming from. I don't remember what his reply was. The guards requested both of our driver's licenses to which we complied. The guards then requested us to both exit the truck. One of the guards told me to stand beside him at the front of the guard shack towards the gate. I complied. My husband accompanied another guard, heading towards the back of the trailer on the driver's side. When my husband reached the area of the hood, coming from around the front of the truck towards the gate, the guard stated, 'I told you to keep your hand of your pocket. If you don't want to comply with the rules, then you can leave!' My husband states, 'I'm comfortable with my hand in my pocket. I don't care if you don't like it. You'll just have to deal with it.' My husband asks me, 'Do you think having your hand in your pocket is unreasonable?' I stated, 'No it is not unreasonable, and we're leaving.' Husband states to guard, 'Fine, we'll leave'. I heard the guard from inside the guard shack yell at the guard beside my husband, 'They can't leave. They're not in the system yet.' My husband was standing between the driver's side spot mirror and the driver's side steer tire. My husband attempted to proceed to the driver's side door but was blocked by the guard as the guard then stated, 'You can't leave.' The guard then held out his arm in a closed fist to block my husband from heading towards the truck door. The guard shut door of our truck and pushed my husband into the steer tire. I went to the aid of my husband after I witnessed the guard push him, as the guards had guns and I feared for both our lives because we were being unlawfully detained against our will. I was drug across the asphalt by more than one security guard and felt pain behind my right ear, they pushed my face into the ground and forcefully held my arms behind my back. I complained several times that I was having trouble breathing at this point. They did secure handcuffs so tight that my wrists and fingers did go numb. One of the guards that assaulted me stood behind me after I was in handcuffs and continued to assault me by brushing his legs against my back, and touching my shoulders and neck. I yelled out every time he touched me to 'Stop touching me!' The unwanted touching occurred 5-6 times. My husband said that every time I yelled for the guard to stop touching me, the guard would laugh and smile. I heard a female guard standing in front of me tell the guard to stop it because the camera will show him doing it, and to move away from me. All in, I was probably detained for 45 minutes to an hour before the police arrived. This is an estimate, as I had no real record of the time without access to a device that records the time while I was unlawfully detained.
This is my rendition of what events occurred. We were disallowed to make any statements as to what occurred in our defense or for that matter, press charges. We have retained council in our defense. We are still waiting for the video surveillance to be released . -

you people are, um, well I don't know what to say on this web site.........however, this pretty much sums it up...... "
My husband states, 'I'm comfortable with my hand in my pocket. I don't care if you don't like it. You'll just have to deal with it.'
sister, look........rules is rules. We all have to deal with them no matter how petty.
Your husband says he's an O/O running 1500 miles a day......therefore, this ain't his first rodeo.
Bottom line, you both screwed up and you should both know better. No sympathy at all.allniter, buddyd157, dngrous_dime and 3 others Thank this. -
Company rules are not laws. We decided the load was not worth our time. We were ready to leave. We are also a team. At no point did he state that we run 1500 miles a day, although it is possible if we chose to. By law, we don't have to wait until we are in their system. The moment the guard made the statement that we can't leave is when it became unlawful detainment. I say when the search stops. I say when it's time for me to leave whether or not they are finished with my id. We didn't even have a load. We never made it through the front gate to pick up a load.

This is a tough one. It will be a cold day in hell when I let some security guard bark orders at me. It's all in how they approach you I believe. I have had one incident of unpleasantness where a manager was involved but this woman was downright spiteful from the get go. I informed the manager that I would not tolearate direspect from anyone including him and I was happy to leave without loading.
The lady guard changed her attitude at that point and we moved on. While I understand the point of view of "it's just 5 mins of your day", I'm loathe to promote that behavior. For the most part it's never an issue, but I sure as he'll won't let anyone take their bad day out on me. I've had plenty of sh##y days where I don't unleash my frustrations on any stranger I come across. What kind of world would we all live in if that was the case?
Some of these shipping clerks and guards need a healthy dose of reality once in a while, bring them back to earth.driverdriver, Cattleman84 and Oldironfan Thank this.
