This weekend is your last chance to submit a public comment on the proposed changes to the Hours of Service (HOS) regulations. Make your voice heard!
FMCSA published their proposed rule on August 22nd, and since then the proposed changes have been hotly debated. ATA and other large trucking interests have been mostly in support of the changes, while safety and enforcement groups including the NTSB have come out against the changes.
Proposed changes include adding flexibility to the 30-minute rest break rule, allowing a ‘pause’ button in some instances for the 14-hour clock, and giving a very slight amount of flexibility for splitting up sleeper berth time. You can get a comprehensive breakdown of the proposed rules here.
The comment period was kept open longer than initially expected after requests from ATA and CVSA came in to extend the window. The final day for giving feedback to the proposed changes is Monday, October 21st.
To date over 2,165 comments have been received. You can add your voice to the discussion on the Federal Register website.

We need the companies to pay time and a half for hourly drivers and also for the ones who get paid milage for our overtime while working like most companies do that’s not in the trucking. But big brother is getting paid for our overtime… big brother is our goverment…
Jajji says
Just start paying hourly and HOS citation to the company not driver and you will see the changes all we need…
Bruce Barbee says
A split clock gives companies more of our time out than at home with our family and friends..

If you wanted more time at home… why are you a truck driver?? You can’t have it both ways.

Exactly!!! NUFF SAID.

Changes the government has in mind, is not going to do anything but help the shippers and receivers. That’s he reap the benefits, not the drivers. Y’all don’t listen to the drivers 😂 that actually drive. Pencil pushers get to dictate what happens
Harry B. Onia says
How is flexibility to the 30 a benefit to anyone else but the driver?
Israel Morales says
Useing a split driving rule helps when u need to deliver a load n get reloaded that same day. This split should also b allowed fr the 14 hr. rule to b pushed further up. Giving the driver a better opportunity to take his time making his delivery. This will help him on his stress levels which add to his road rage.
Harry B. Onia says
agreed
Hipolito Acosta says
Agreed

All talk and no good action for Drivers. Government could care less. They want you to think they care. Just look how they have screwed 😡 up that got the industry now. Crashes are up and going to continue to go up. Because the government KNOWS best lol
James says
I still say, disband the FMCSA. then the lobbyists can’t dictate what my life style should be.
Michael tharpe says
I agree get government out of our business
Phil Haultain says
While I currently do not work where a sleeper is required, I will say that my “Inner clock” does not respond well to, “OK, time to sleep for 10 hours”. My inclination is that I sleep when I’m tired, even if my destination is 1/2 an hour away. Office chair jockeys may believe that it’s as simple as switching yourself on and off, like a light switch, but life seldom conforms to such a rigid doctrine as proposed in the HOS rules. There needs to be some wriggle room there, along with accountability to those who would abuse the rules.
Mark Gillespie says
The only thing you should be working on is being able to hard wire gps eld in all non compliant ELD trucks so everyone is one same page, coz now you have people still doing it illegally n having logs without numbered pages should also be illegal.
And if your with a good company you do get paid to seat and wait for loads n it shouldn’t be up to the fed but to your company.
Pete says
I would like to see the 30 minute break go away. I drive for a LTL company And I do a turn every day. All the break does is make me tired. Costing me more time on the road.
H Pender says
It doesn’t matter what anyone says it going to be the same crap. Go back to the days before the 14 hours crap came in the trucking industry
Orlando says
We don’t need the government telling us when to drive or when to sleep, you are all a bunch of cowards, none of you have the balls to say it like it is
Michael tharpe says
Oh no I’ve been saying it for a while you don’t understand you work for the government you just don’t get the benefits
Wendell. Dreasher says
Why dont you let us be productive instead trying to be control freaks why just cant we work a 70 hours in 7 days keep all your other dam rules that way we can work every week start over on hours 8th day and start our 70 clock each week
Barbara says
We have 11 hrs of driving! We get ripped out of our 11 hrs daily due to traffic back ups, and road construction! We should get extra driving time to make up for what we loose! Its not our fault traffic is what it is!
But we get RIPPED OFF OUR HOURS!
Harold Hodge says
If the federal government really wanted to handle or help with the HOS they would do a study on the Circadian rhythm – circadian rhythm – circadian rhythm PERIOD
Carl Shantel Sellers says
Dont mind the 14hr clock and finally going get something to extend it but have 2 charge shippers double the fee if we sit longer than 2hrs. They will try and hold u longer bc we got wiggle room now. 30 min break not a huge concern. Let’s talk about otr drivers who have 2 always sit bc out of there 70hrs. Add 10 more hrs 2 the 70 and drivers could deliver 1 more ld and have enought time to make it home and u want nd pc as much. Truckers feed america so y is it we dont get better pay
Ronnie F Hatchell says
Driver should sign on to his computer and be allowed a 12 hour work day. Then sign off and not be allowed to drive for 12 hours. So you work 12 on 12 off. We need an hourly minimum wage , about 25 dollars per hour, this includes anything we do during or time we sign on. If we are at the shipper for 5 hours then that is there problem and the driver gets PAID. At 40 hors time and a half should be started ( 37.50 per hour ).. Driver shortage will decrease very fast and shipping waiting times will decrease. The trucking company contracts with shipper to charge them 75 dollars per hour after two hours. No more driving lines or sleeper berths or on duty, everything is on duty once you sign on for your 12 hrs. Wow no more worrying about when my 14 hrs are up or I have to find somewhere to shut down for 30 minutes just to waste more of my time.
Ruth VanderVliet says
You’re always talking safety. Do awaywithe 30 minute break. I’ve seen more trucks parked on the shoulders of the roads now than I’ve ever had.
How do expect a local driver to work 14 hours one day then have him or her to work a 16 hour day the next day and the rest of the week either 12 or 14 hours until they hit their 70. Trust me, the companies are using that 16 hour every week. I say do away with the 16 hour rule
kc says
This one size fits all policy is a bunch of non-sense. Government has proven time and time again that it put forth policies without knowing the absolute true facts. Pooling safe drivers with outright unsafe drivers is a major problem. The major question is, How is there a justification for this? ELD is not the answer, putting speed limiters are not the answer there is no correction for stupidity except for stupidity to correct itself. There is a responsibility of being a professional driver and until that is understood by all big rig drivers that’s when the system will work.
Randy keebler says
All this does is compensate for inappropriate shippers and receivers , it lengthens your day makes it physically harder with no extra pay, the only way to correct these problems is to all go hourly pay, with a maximum hours allowed daily as well as weekly, works in Europe
Fred Christopher says
Is just night right how the government is doing this to us the hard working men and women who risk our life driving truck to make a living, putting all these restriction on us, just let us drive wight paper log book please, if we only how 1 truck we don’t need a e log
Javier Rodriguez says
Why don’t they require a red painted 25′ ft curbside on all residential neighborhoods into the driveway of any business that receives truck load deliveries ! This is a lot of pressure on driver’s getting in / out of these driveways w / car’s parked next to the delivery driveway ! Believe me I get this a lot !
Javier Rodriguez says
Why is California allowed to work 16 hours / drive 12 hours versus everywhere else U can work 14 hours / drive 11 hours ? I don’t see 1 reason why California is Exempt ! Shouldn’t it be the same !
Rudolph burney jr says
Do away with the 30 minute break.
Carlos Moreno says
Yeah cowards go back to the rules before
No eld to cowards or get fired like raymond
Good x nothing people
T.c says
So somehow they think the flexibility in the 30 min break helps? And turning a 14 hr day into a 17 hr day helps us get rested? Companies, will use this rule to just kill drivers! It’s already going on. The great eld mandate only took more time away!! For those who use them. Buy an older truck you evade using eld’s!
Everything FMCSA does makes things worse! All in the name of safety. Yeah the roads are more unsafe now than I’ve seen in 35 yrs.
These new hos rules will make it even worse. But hey….automous trucks are coming this way they can say they are needed !! Because trucking has become so unsafe! It’s all part of the plan.
Stop messing with the rules!! If you can’t actually come up with common sense rules, leave well enough alone.
David says
I still think the hole E L D thing is a big joke and a waste time and money
greg tippens says
I dont mind the 30 minute break. We all have to eat. It’s a good time to do that. I like the hours of service just the way they are. We dont need to work harder. We need to get paid better. Maybe it’s time to go the unions again. I dont know. I think better pay is the answer not working harder.
Paul Yeater says
The HOS stinks!!!! I sat at KW dealer for 5hrs getting repairs OD but clock still ticks down and had no time to make pick up. We also sit at customers for 2-5hrs waiting to get loaded or unloaded while clock still ticks down.
We should be able to stop clock in these situations.
Robert mackie says
It doesn’t matter what we think or what we want we’re never going to get it because the government’s not going to give it to us but the government don’t realize that without truck drivers do United States. To exist stores only have enough product in their stores the last 3 days they need to stop putting a logs in log books and stupid weight limits on us and treating us as Revenue instead of actual employees like a person that works in a I’m not office building or a police station or Fire Department but we’re Revenue we can’t even get the speeds raised especially in California it’s a shame that everybody else out there gets respect but the Overworld truck driver in the local truck drivers don’t get no respect at all we get spit on it’s a shame government needs to turn around take their head out their asses and leave us alone and let us do our jobs instead of going after our wallets and our license we have families we have to support this like they do
James says
ELD’S Can not tell you when I’m a driver is fatigued or tired all it does is dictates the hours your allowed to drive.Companys don’t pay enough right now because some pencil pusher is always trying to make a little more money for the lobbiest showing up talk to the Democratic party to push this stuff through. We need to make a living , and be able to have home time. Jimmy Hoffa had the right idea all along.
Santi Bailey says
The funny thing is all these changes but nobody wants to talk about states like IL that have experienced a rise in truck deafs since December of 2017 plus Warner the quote pioneers of the elds just paid 40 million dollars in a lawsuit for doing very unsafe practices
Nicholas says
Ive been out hear over 30 yrs owned trycks, and drove for companies i still own my own truck, the problem is the shipper and the reciever. They dont care how long it takes to load you or unload you! Even if you drive flat bed it can take up to 4-8 hrs to load.IE,MENARDS/WALMART JUST TO NAME A FEW.IVE PULLED REFERS FLAT BEDS STEP DECKS ETC,OVERSIZE LOADS ETC,the Elog is the worst thing that could have happened to the Driver!! You cant beat time period.when i started driving we split the sleeper birth, never ran out of hours never drove tired could eat, shower etc.the 30 minute mandatory break is plain Stupid! Your body startes to unwind and relax, then you force yourself to drive tired until your 14 hours or your 11 hours is up.then you try to sleep now you cant sleep.i can’t sleep 10 hrs i sleep 5 -7hrs.then i have to wait for the clock to reset again. Also the PC.rule doesn’t work for the owner operator, and according to the DOT,YOU CAN ONLY USE IT IF YOU NEED TO GET TRUCK STOP,WALMART OR RESTERAUNT. BUT EVEN IF YOU ARE UNLOADED HOOKED TO YOUR TRAILER,IT IS STILL CONSIDERED PART OF THE LAST TRIP UNTIL YOU RELOAD.SO PC IS A JOKE!!. But i would like to see all tranportation government agencies have to be on the same clock they expect us to work on,going to work logged onduty driving, work all day then log there sleeper off duty and driving hours the same hours and rules they create, that includes all lawyers, etc!! But the biggest problem is always going to be the shipper and reciever. And lack of truck stops nation wide! I see trucks parked on the shoulders of the Interstates, on and off ramps for every big city, and drivers getting tickets for parking on the road because there was no where to park.to be safe, the only good thing about the Elog is if you have an incident it shows you are compliant.but otherwise it puts a lot of un necessary stress on the Driver.the Last Dot officer i spoke with told me that dot wants to change the rules towards drivers hos by a new rule being contemplated as if you have to drive to work that all the hours you drive to work from home should be on duty driving etc,so more rules are being proposed by the FMCSA,the way i was told by the officer WISCONSIN also said that they want the time spent anything to do with the truck needs to be onduty paperwork etc.and that they want duty status to start as soon as you put your key in the drivers door it will electronically put your Elog on duty,so be prepared to lose more time, more stress less commerce, its no longer about the driver its about total control over the industry! We need real Representation for the drivers and owner operator, but there is none at this time, but i guess we will see what the new rules will do for the industry.the 34 hrs needs to be 24 off to restart your hos in my opinion.
Shawn Hnderson says
I really don’t think there listening to us. There’s mind are made up and have been made up. Just keep moving the date back further and further for what. They see the numbers they know its gotten worse and worse overtime, but yet they want it there way. Been in this industry 25 years and am about tired of it. Want to make it better let me drive when I wanna drive and sleep when I wanna sleep and take a break when I feel like taking a break. Just like the over worked law enforcement, doctors and nurses and many other professions where they work all day and hardly sleep, but we trust them to keep us safe.
George says
Then when all the comments are in we ll have to wait for another year at least to get it to be law….incompetent nincompoops at FMSCA you should all be forced to go on the road for 1 month before enacting any laws! For now, I d fire you all and have you spend 1 year driving so you could see how ridiculous your hos are!
Bai ji says
No one wants to listen to a good alternative to HOS. Will anyone consider my theory? Please take all the log books of the trucks. Only single drivers in a truck and 12 hours of drive time per day from midnight to midnight in any given day. Driver can split it the way he wants to. You will find way less tiredness and accidents on the road due to the tires or under slept drivers. By the way I have been in this business for over 23 years behind the steering mostly. Since they (dot) tightened the rules every driver is driving yawning. Body needs to sleep but log books say you drive vice versa. Please someone give a thought to it. Also the DOT can cap the milage driven a day per truck per driver. Like between 700 to 750 miles a day. We will not have a driver shortage too. Thanks.
Carolyn says
Seriously….as trucker who owns their own truck and works off the load boards, I dont understand how anyone can haul a load for under $2.00 a mile for 40,000 pounds. Who in this industry who owns their own truck, pays their own fuel an insurance can afford to haul for $1.5 a mile….who is accepting these rates?
With that said…the shippers and receivers who take 2- 8 hours to load and unload need to be penalized, no only does it interfere with the truckers future pick ups and deliveries but if logged in as on duty uses up all of the truckers drive time. …these things need to be addressed..
