Agreed still need probable cause to break into someone's property. I suspect any officer doing what he says would be suspended at the least and fired at the most.
Supervisor: what evidence/cause did you have to suspect the driver was in jeopardy?
Officer: they didn't answer me when I knocked.
Supervisor: what else?
Officer: nothing.

I thought about it in terms of my 10 or 8 being cancelled out and needed to be restarted. 7/3 split will help here but that's just a half arse win...why not split anything with at least 2 hours sleeper or more: 4/6, 5/5?
It was like that before 2004: 2/6, 3/5, 4/4 etc but there are always some PhDs who think they know better from you when you are rested or fatigued and put everyone in the same category.
This interruption should not force someone into resetting the rest clock all over. If it ever happens to me, I think, I'll mark the Inspection as off Duty and move on as if it did not happen.
After all there is no f... way that staying in the sleeper for 7 hours and 59 minutes or less followed by another 8 hours due to DOT interruption is assuring someone's rest. I'd say it is stupid, idoitic, counterproductive and simply overseen by current HOS rules...which means we need to use our brains and so should the law enforcement.Last edited: Aug 29, 2020
