Violated hos, company wants me to sign a form? should i be worried?

    They want you to sign the form as a way to acknowledge the violation, that you have have been counseled about it and are aware of any consequences that may come from future infractions.

    I've done that many times at shippers & receivers when the wording on the form put legal liabilities on me even for something such as a lumper getting injured.

    The trucking companies are required to check for HOS violations and correct drivers that don't run legal. When drives had paper log books they would even get drivers for adding up HOS wrong at end of the day. So just try and follow the rules better. It not a big deal unless you keep making the same mistake.

    Don't sign it if it's not a true account of what happened [i.e., your version of events]. Make them retype it to reflect your side, if necessary.

    I had a safety manager try to get me to sign a document saying only their version of CYA. I didn't want it on my permanent record and so I objected to the content in the document. He through a hissy fit and after huffing and puffing, he changed it to reflect reality and not their own version of CYA.

    That's when I signed it.

    They can always fire you with cause and point to whatever document you sign. That means goodbye unemployment benefits and mandatory arbitration- if that's your thing.

    I've never sued anyone nor have I ever collected unemployment, but I certainly don't want any former employers having the ability to put things in an employment history file/database that isn't true or accurate that may affect future employment.

    This is a common practice with the company driver’s. They have them sign the print out, usually for HOS, and excessive speed per company regulations. It’s basically a slap on the wrist, letting you know you did a no-no and they are protecting themselves incase of an DOT audit.

    EDIT: If the company driver keeps violating the HOS, they eventually get the boot.

    If that's the case I would think the entire staff could spend 6+ months in greater Chicago and not even dent the stack of violations they'd discover in a log audit.
