What counts as a "Moving Violation" - Do you have to get a ticket or can something on your DAC count

    I recently quit a company and I'm not sure if they put "incidents" on your DAC report or not. I've ordered a copy of my DAC and it should come within the next week hopefully. Both of these incidents occurred in the past couple of months, so recent.

    The incidents were:

    1. I ran over a curb/patch of grass at a warehouse. I notified the warehouse and my company. The warehouse didn't seem to care and the managers were surprised I even reported it as the only damage there was to the grass, which will grow back.

    2. The second one was a bit more serious. I was going too fast on a truck approved road going uphill and going over railroad tracks. My truck bounced on the tracks and it messed up the landing gear enough that the whole landing gear had to be replaced. No damage to other vehicles, no accident, nothing like that. The landing gear didn't fall off either, it just got bent all to hell.

    For both incidents, obviously the cops were not called for either one. But I did notify my company of each one and they wrote it up in their system for both incidents.

    So my question is, what counts as a "moving violation"? If these incidents show up on my DAC report, does that count as a "moving violation" even though I didn't get a ticket? Or would that be considered an "incident" which for insurance purposes would be different than a "moving violation"? Or considered something different maybe?

    No cops.
    No accident report.
    No violations.

    Not sure about insurance or DAC, but neither incident would be on your state driving record.

    My guess is the 2nd one would be on a report but not the first. If your company had to file an insurance claim, then it would show up on a report.

    That's kind of the point of my post though, is to make sure that I DON'T rat myself out. On some of these companies applications they are going to ask me to list any "moving violations". Even if these 2 incidences don't come back on my DAC, can't it take 4- 6 weeks sometimes for stuff to show up on DAC?

    So in that case, I'm at a loss for whether I need to list these two incidences or not in case they DO show up on my DAC, either when I get my report back next week or if they show up on my DAC 1 month from now.

    If the police weren't involved then maybe it's not a "moving violation"? Therefore I would be answering truthfully if I didn't list either situation as a "Moving Violation"?

    I'm basically saying I want to answer truthfully on the applications but I don't want to rat myself out for no reason either, if that makes sense.

    Hence the question, what counts as a "Moving Violation"?

    Moving violations are when you get a ticket from a law enforcement officer for things like speeding, tailgating, running a red light or stop sign etc. When you pay the ticket or fight it and lose that conviction will be on your MVR. What is on your MVR is what they are asking when they say "moving violations".
    Your screwups may be on you Dac if your company uses Dac and if they reported it to them. Many companies do not use Dac.

    I kind of feel bad for you with the railroad track incident. They need to put big loud signs when they’re uneven and lumpy and bumpy like that. I’ve hit a few lump ones and while I’ve never damaged anything definitely sent me rocking up and down for a few seconds.

    If you simply ran over the corner of a grassy area and it wasn’t like some persons private home pedicure landscaped yard? I definitely would’ve kept my mouth shut on that one. Lol

    Thank you this is exactly what I was looking for. The MVR is what matters when they are talking about "moving violations", not the DAC (although obviously there are many times drivers have something show up on both their DAC and their MVR but that won't apply to my case).

    Moving violations ae offenses cited by law enforcement.

    Insurance looks at them in two ways.

    Minor offenses like stop sign/light tickets and low speed violations.

    Major offenses - Speeding more than 15 over, Reckless driving, Hit and Run, Commission of a crime while operating a CMV - BAD STUFF.

    Nothing to do with your two little things.

    Sure your company may be upset; Landing gear replacement runs around $1500.00 to $2000.00 and most places like to see them worn out and broken first.
