    Wonder what those deputies were doing at the loading docks. Besides loitering.

    So the smartarse got lucky and won the lottery.

    Yeah, the cops were obviously wrong given that they paid out.

    But, why couldn’t the guy just have said “evening officers, I’m here making a delivery”, instead of spouting his mouth. What the #### is wrong with people.

    He had a delivery manifest in hand,along with muffins,plus he was in uniform-that should’ve been their first clues.
    Not to mention the delivery truck in the loading dock.

    Also,they could’ve contacted the store he was delivering to (like he did) to see if he was actually delivering there.

    He didn’t get lucky,the officer was incompetent,and the county is paying for it,literally before the jury awarded any more punitive damages!

    I get that. There is blame to go around. But if he wouldn’t have been a dick the encounter was likely to go differently.

    There have been people who were respectful and they still ended up getting arrested or worse.
    Either way both the prosecutor and the federal jury saw through the BS in this case. The sheriffs department was in damage control mode. The officer involved is lucky he wasn’t charged with aggravated assault (and battery)when he grabbed the driver’s hat off his head and threw it in disgust while the driver was in custody-that alone can result in punitive damages against the sheriff’s department!

    I agree.
    He lied.
    He said he was just walking.
    Not Walking AND eating his muffins.

    But..Thus from their state site.

    Under California law, “loitering” itself is not a crime. However, it can be charged as an offense under certain California Penal Code sections if it is done with certain other acts. Some of these penal code sections include: PC 647h, loitering to commit a crime.


    But not to be walking and eating muffins, so it was illegal and violated his legal rights, and by not letting him talk to a supervisor.
