Most applicable to a small fleet owner who has no one looking over his shoulder. What leverage do I have if my employer withholds any of the two paychecks remaining after I leave?

Sue? Well, that costs money. Call him names? I just want the money. Just wondering if anyone knows exactly where I'd need to go to turn up the pressure to get what is rightfully owed to me?

    TIA

The only leverage that you have is to secure another job before you hand your current boss your letter of resignation.

Thanks, but that really makes no sense. Just wondering if anyone has been through the process and knows what forms I have file and where.

I always worked for larger companies and they couldn't hide it from the payroll department if anyone wanted to cheat me.

Small fleet owner, there's no one in his company watching what he does. Hoping there are state and federal agencies that handle this kind of claim.

Yeah, small claims court, and how much is that going to cost someone who makes his living being away from home? Lawyers? Whoo boy! I'm not trying to pay out more than I recover.

Are you a W2 employee or a 1099 “contractor”? If you’re 1099 then your only option is court and also turn him in to the IRS for misclassifying you.

I don't want to deal with the standard grudge many have against 1099 jobs. It's being done all over and if the government isn't doing anything about I'm not going to make it my crusade.

I had a great W2 job. And, a driver facing camera. They didn't pat me on the back for trying to record the noise the truck was making. They put me on probation. Firing didn't take long after that.

So no, I have no apologies for entering the world of 1099 small fleet owners. My first experience was good. This time, I just want to be able to tell the guy what's next if he doesn't pay me.

Had a landlord withhold my deposit after I moved out. What he didn't calculate is I had the phone numbers of his other two tenants. That's what you call leverage.

Roehl Transport did this to me before they terminated my employment, I just moved on because I've heard stories from so many other people that have had Roehl do similar things to them as well with no recourse.

Now, that's a shocker. I didn't think any individual could do that without the whole department knowing we are employed by f****s.
