Yes, the Commercial Vehicle Safety Alliance (CVSA) can be challenged, both in terms of its policies and its enforcement. Individuals or organizations can challenge CVSA's actions through established processes, including submitting issues or requests for action regarding policies, or by leveraging legal avenues like the Surface Transportation Assistance Act (STAA) for whistleblower protection.
    Here's a more detailed explanation:

    1. Challenging CVSA Policies:
CVSA's policy development process often involves consultations with various stakeholders, providing opportunities for individuals or organizations to express their views and contribute to policy decisions.

    2. Challenging CVSA's Enforcement:
The Surface Transportation Assistance Act (STAA) protects individuals from retaliation for reporting safety violations related to commercial motor vehicles, according to Truckers Justice Center. This can be used to challenge actions taken by CVSA or its members that violate safety regulations or retaliate against individuals. If an individual or organization believes they have been unfairly treated or harmed by CVSA's actions, they may explore legal options, such as filing a complaint with the Federal Motor Carrier Safety Administration (FMCSA).

    3. CVSA's Operational Procedures:
CVSA's operational policy outlines how inspectors can challenge written examinations to demonstrate proficiency if their certification has lapsed or if they fail the initial test. There are limitations on the number of re-tests and challenges allowed. CVSA provides guidance on North American Standard inspections, including levels of inspection and the documentation required.

In essence, CVSA is not immune from challenge, but it has established mechanisms for addressing concerns and ensuring accountability. Individuals and organizations can leverage these mechanisms to challenge CVSA's policies, enforcement actions, and operational procedures.

    • If an individual or organization believes a CVSA policy should be revised or a new policy should be added, they can submit an issue or request for action, according to CVSA's website. This process allows for feedback and potential policy changes.

Whatever they did to challenge it in 2015 to get it removed they will do again.

Yes, I read that. But that wasnt the underlining motivation behind it. Some outside group, company, or whatever raised a challenge. How it got escalated to Obamma is anyones guess...

Based on the constitution a valid argument could be made based on the 1st amendment against this regulation, and frankly is likely to be the original challenge. And until english is finally ratified as the official language of the US (which if you read below you will find this has been tried several times in the past and failed each time), I have to believe that because of case law the conservative supreme court will uphold and deem it unconstitutional.

Dont get me wrong, I fully support having english as the official language. But I spent 12 years in the military defending the CONSTITUTION (6 years of that 12 in the actual unit that guards the physical document - the 3rd US Infantry Regiment). I swore to defend the CONSTITUTION with my life, and I meant it. And until they change THAT document that will continue to be my stance on it.

And Trump just by saying something, doesnt make it law. An executive order is only issued to departments that fall under the executive branch of the government. An executive order stating that english is the language of the US isnt worth the paper its written on. We have 3 branches to government for a reason.....

In short, if they want to make this into a law, the FIRST step would be for a constitutional amendment making english official. And that is done in congress. Congress is supposed to represent the people.

The U.S. Constitution does not explicitly designate English as the official language. While English was the dominant language at the time of its creation, the Founding Fathers chose not to formalize a link between language and American identity. They also considered that at the time there were many languages spoken, including German and Dutch, and didn't want to offend anyone.
    Here's a more detailed look:
The Constitution doesn't define an official language for the United States. The First Amendment protects freedom of speech, which applies to all languages. Many states have their own language laws or constitutional amendments, with some designating English as the official language. English is widely used as the de facto official language, with a high percentage of households speaking it exclusively. While several bills have been introduced in Congress to designate English as the official language, none have been successfully passed. In March 2025, an executive order designated English as the official language of the United States. Some states have state constitutional amendments that designate English as the official language in their jurisdiction. While not explicitly in the Constitution, the naturalization process often involves English language requirements. The Constitution protects freedom of expression, which applies to all languages. The Founding Fathers were multilingual and encouraged citizens to study languages. In the past, the Constitution was translated and distributed in other languages (e.g., German) to encourage participation in ratification.

Oh? What if nobody challenged the previous OOS criteria and then they received their “guidance” about it? You’re good at Google and copy/paste, I’m sure if there was an actual challenge to it you can find it on the interwebs.

I don't care where you're from, if your driving a commercial vehicle and cant read the signs or talk to an officer without a translator, you don't need be driving commercially. Everyone acts surprised but here's the thing: countries in Europe have a law in place making it hard even to get a job if you're not a citizen, had a relative who was working a long time there, and when the law was in place, they were let go. It wasn't even a driving job, and the dominant language was English. This idea to protect your citizens isn't new either its just been covered to allow others in with zero checks and balances to the system. The system being our low rates some idiot willing take a load for next to nothing. I know people gonna hate this because maybe it affects you but when you go to another country you should be able to understand whatever country you go to before going or look like a idiot. I went to Japan with my uncle who was in the military when I was a kid and before I was allowed, he made me learn Japanese said it is disrespectful if I didn't learn the language enough to talk to people.

Factually incorrect, there is no official national language in the usa, it is *de facto* english, not official. its the same as religion here, predominantly nominally christian, but no state religion...

If I was a lawyer and was getting paid to do it, I would. But as I said, CASE LAW backs the first amendment. And until the constitution is amended to make english the official language of the US, its an uphill climb. You can sort through google if you want...
