Hello, if this question has been asked before my apologizes ahead of time. This question is intended for drivers who have knowledge of this please.
I managed to get an interview with Air Gas as a hazmat driver with a little over two years experience as a A class driver for another company that pays little to nothing barely getting by until now.
I got in trouble in 2019 and was arrested charged with 3 misdemeanors and got two years probation knocked down to 11 months instead. I got my criminal record expunged in March of 2025 not sealed to be clear.
Does the background check show up for a company like this if your record is expunged? I ask because the lawyer I had said since my record is expunged I should never bring it up to potential employers but with this being a hazmat job and a company like this I'm conflicted. I want to be honest but fear if I mention it they won't even consider me. I really need this job. Anyone with knowledge on this would be appreciated. Thank you in advance for your replies. I'm not sure what exactly "Expunged" means in legal terms, but I know this. I would follow the advice of my attorney before I'd take any advice from a bunch mopes on an internet trucking site.

We've gone through this before.
Once a charge is in the system, it is there forever. The systems do not remove records.
This does not mean it appears on a standard background check, but if someone digs for it, it will show up.
Would I worry about it?

I've got an expunged charge on my record. Then my dumb ### didn't stay out of trouble lol. I didn't disclose the original charge that I had expunged. The trouble I had after that charge, I had to disclose. If I remember right, you won't even see the expunged charges. Your lawyer advised you right and would also know best. Follow the legal expert.

Expunged means it's all pushed off. Arrest record hidden for that charge. Court can't see the arrest, or charges afterwards but i dont completely believe that.
Sealed it's still there but only law enforcement/ courts can see it. But this 2025 not 1990 so all things exist on the internet for ever.Stringb8n Thanks this. -
You can legally answer "no", and not mention it. It may show up depending on the type of background check they do, as I imagine not every database is going to receive information that the record has been expunged, but I would cross that bridge when it comes. If it was truly expunged in March of 2025, and it is truly expunged, then you should be okay to answer "no". Expunged = like it never happened.

Generally speaking, misdemeanors are not going to be a problem even if they are still showing up on a background check. UNLESS those misdemeanors are things like DUI or Reckless Driving, etc.
Here is what I tell folks when it comes to filling out an application. Look carefully at the questions. Then answer them honestly. Example. You thought something was expunged. You answered that question no, believing this to be legally honest. If during the interview you get asked about it, showing up here is where you mention the expungement. The company will then decide what happens next.
There is no point in worrying about something you can not control. Stay honest with your answers.
