Detention on Reefer Loads

    Typically on produce like it states in earlier posts, there is no detenttion unless stated in the confirmation. The usual go to is not to have detention at the shipper and after 4 hrs at the receiver unless it states less. an average price i have found was $50/hr to keep both sides happy but ultimately it is up to the customer to pay it out. Certain commodities never pay detention no matter what because of the volatility and the factors that can delay them are vast.

    I quit time stamping the bills, because I never see any detention pay for it.
    Detention pays when customer pays, is a big joke.

    The thing about many brokers is they will bill for detention and pocket the money after they lie to you. Talk is cheap in more ways than one. You must get it in writing.

    My last company billed $80/hr after 2 hours but I got varying amounts as a company driver. Sometimes none, sometimes average and sometimes surprised with a large amount. It sometimes took up to 4 weeks to get reimbursed. The buck doesn't change hands until they have it in theirs.

    /// wait a minute?,ur gettin' paid detention? do they need any more guy's?, thought you had a problem gettin' paid? I stumbled on a Federal rule, that scare's the hell out of'em, look it up read all it it, but mostly 785.17,16,15, you'll love it, spread the word Son, all them bad guy's that pull that crap, are about to eat magpie's??

    /// ain't that the truth?, but, if you were to look up US Code// title 29, @785.15,16,17, you're gona get a full clip of ammo!, to nail'em with, says in part"Truckdriver's are ENGAGED to wait, and is part of the work, while you're waiting to load , or unload, you must be paid your daily rate of pay, please do look this up and when you get them skaggin' in there boot's, there gona start thinkin' twice about not paying for Detention, Read all of the Federal Rule, and USE it to get your money from now on, I did, nailed Hireright, $4100.00 got another crook in Vegas, for 4228.00,let me know what you think once you read it, It's what I'd been lookin' for since I got in this Racket!!

    The specific law...

    All that stuff says is you are working while sitting on the customer property. Truck drivers are exempt from hourly wage if they are paid by the mile. Detention pay is considered accessory pay which all accessory pay must be negotiated prior to the event. There is no law that says exempted drivers must receive detention pay because cpm are suppose to cover everything.

    I think you need to brush up on reading skills. You arent gong to win any battles for detention pay by quoting some Code. We put 4 hrs free time in produce. 2 hrs in dry frieght. We arent REQUIRED to pay anything for produce, but we do because it is NEGOTIATED at the point of booking the load.

    Which lines are BS? Certain commodities DO NOT pay detention, typical time is 4 and 2 hrs. typical pay is $50/hr.
    Like we say in poker, dont count your chips while you're sitting at the table-- Best of luck with the code
