In light of recent events I feel it is time to post this. I am sure many of you know this but do you really know it.
It is our inherent nature to "do the right thing". We want to help. We want to stand up and face our mistakes head on. In short, we are stupid.
Trucking is big business. It is a business that attracts lawsuits like blood does sharks. When something bad has happened there is no way to undo the accident. All you can do is protect yourself and those you love by understanding that no one at an accident scene is your friend. They might not be your enemy but they are not your friend. And they are definitely no one that you need to be making any statements to.
Things happen quickly. If an ambulance comes, go with them. I don't care if you feel fine, go with them. If a wrecker comes, do not let it hook up to your truck until you have called your insurance company. Your dispatch should do that for you but if your truck is not blocking the highway it is not up to the wrecker company to make decisions. It is your truck. You make the call. If Joe Blow hooks up, it is going to cost your insurance company $30,000 to have your truck and trailer towed. If you insurance company talks to them, they are going to save thousands. A tow truck driver has the right to make a living but there are many of them who take advantage of the confusing to make large amounts of money.
Do not tell anyone that has been hurt how sorry you are. That is one thing they will remember. The trucker said it was his fault. What else does "Sorry" mean?
Do not tell the police that you were up all night and could not sleep. Let your logs speak for themselves. If you have a dashcam and you believe that it might just show something that isn't the way you wish to remember it? I can't tell you to destroy it but things do get broken and a magnet might accidentally erase things.
Drive safe but remember to keep your mouth shut.

And. If it's not "serious" & you can buy your way out of "reporting yourself", like buying someone a new mirror or headlight. That might be better than having an "accident" on your record.

Ask for a Independent lawyer, Not the companies or the local provided to you.

I think most if not all carriers provide an "accident kit" that includes a number to contact the insurer and that's at the top of the list of things-to-do after checking on injured parties.
The important thing is to keep your yapper shut about any circumstances regarding the crash. No statement made at the scene of a crash can help, but they can hurt.
You may say something as simple and seemingly harmless as "It wasn't my fault!", but a witness may hear "It was all my fault!".70s_driver and Shaggy Thank this. -
