So if it was a building, would the building have to pay half?

Probably not to prevent them from being crashed into. You hit a stationary inanimate object, it ain't the fault of the object. Violating truck stop parking directives is not "illegal".

There seems to be a tendency for motorists to conclude conditions were identical when they arrive as when any vehicle in a lot was parked "funny". I regularly visit a packed parking lot where the first available space has vehicles on either side parked funny.

Who parked first? I can't tell, how do you do it?

It's a Facebook page. I looked at it. The guy claims the driver forgot he was pulling a trailer. I'll look for a link.

Says you. My brother-in-law the cop says different about illegally parked cars that get hit.

Correct. but OP said they were parked "illegally". Illegal means on a street, road, highway or whatever. If not, it wasn't illegal.

You would be far better off to just assume whatever I post is a fact.

Does it matter who parks first over top of the NO PARKING sign painted on the asphalt?
Or how about when I am sitting in my truck and I watch Mr. Dumas set his brakes perpendicular to and in front of 8 parking places because he can't back into one of the 8 that he just blocked? Does it matter who parked first then?

That's how I can tell. It ain't rocket science but whaaaaatever. Hope you enjoyed your day at the mall.

First of all we are not talking about a stupid building geez some people. We are talking about a vehicle that was parked illegally and it was done willfully and negligently by it's operator, presumably human but more likely sub-human who in all likelihood knew it was parked illegally and did not put his 4 way flashers on.....And since we are talking about an ILLEGALLY PARKED VEHICLE (not a building d'uh), then allow me to answer your question by drawing a parallel. If the building violated local zoning laws by being too close to the road then it could be argued that the building was in fact parked illegally, and therefore it might be possible for the driver to be less than 100% at fault.

Furthermore, my client has driven 2 million accident free miles in a class 8 truck and your building has been hit 27 times in the last 12 months, so YES, I say the building is at fault.

Not too long ago saw a guy park illegally at the end of the fuel island even though plenty of empty parking spaces available. He was driving an old cabover that looked like it had been refurbished and looked practically new. He made if very difficult for drivers that had fueled to make turn out of the fuel islands. Some driver wiped out the front of the cabover and kept going & no one reported who did it. Drivers that are foolish enough to park illegally ask for problems. Saw a Schneider truck get his driver door mashed and mirror knocked off because he parked illegally in a rest area. He was sleeping so hard he didn't even know he was hit & the driver that did it kept going; don't blame him a bit either.

    Okay "Rank"....

Says you. My brother-in-law the cop says different.

I learned a long time ago to not trust anything my brother-in-law told me. Especially if he was a cop.

Correct. but OP said they were parked "illegally". Illegal means on a street, road, highway or whatever. If not, it wasn't illegal.

No...illegal could mean they were in a legal parking spot, but not technically allowed to be there, i.e. handicapped spot or a spot that only allows for parking during certain hours.

You would be far better off to just assume whatever I post is a fact.

Apparently you have been hanging out far too long with your brother-in-law the cop.

Does it matter who parks first over top of the NO PARKING sign painted on the asphalt?

It does if you parked there first and obstructed the signage.

That's how I can tell. It ain't rocket science but whaaaaatever. Hope you enjoyed your day at the mall.

I'm sure he did...he probably got those Miley Cyrus concert tickets you've been asking him for.

LMAO. I guess then he would be parked illegally then huh. Did I go too fast earlier?

I don't understand the reference. Regardless, it's childish. It seems I've struck a nerve. I think I know how you park.
