out of drive time but still gotta drive.

    Okay so this has probably been asked before but here the situation. Yesterday afternoon Hubby and I arrived at a shipper with 3 hours of drive time left and 4 hours left on his fourteen. We were at shipper for almost 7 hours, therefore we were out of time, the shipper said we couldn't stay there so we drove 3 miles down the road to pilot and he got a service hour violation warning on qc. Called company and explained they said that it was okay. SO my question is how bad is this type of violation?

    It isn't bad, you did not have an option and you went to the closest place you could. I would like to know, is the company requiring you to start a new 10 hour break after your 3 mile drive to the truck stop?

    Doesn't matter what the company says. You would have to restart the 10hr break in order to stay in compliance with HOS.

    Just be glad you found parking at the pilot. A 3 minute overage should be ok. A 30 minute overage another story

    Yes we had to do a ten hour break to go again. And we lucked out right as we were pulling in someone was pulling out of a spot.

    I'm not sure about the location. You could have done a 8-2 split. Put the off duty time on sleeper birth. You said it took them 7 hours. Well you could have pulled off their property slowly and then parked on the side of the road for an hour and you would have gotten time back. Unless of course there was no room to do that then what you did was fine.

    Unless he got some sleep during that 7 hours, I wouldn't recommend doing the 8-2 split. No point in driving tired if he had to be awake the entire time.

    Not to be rude, but Nobody cares about your safety or mine, at the end of the day all anyone cares about is: are you compliant wih laws.

    One other thing to know.... had there been some sort of collision involving your truck during that drive, even if it was some crazy drunk driver.... your husband could have been in huge trouble. One of the reasons I left my last job was this sort of thing popping up about 3 or 4 times a year. One way to 'cover your tush,' would have to explained to the receiver that you're over your 14 hours, and it's against Federal law for him to move, and could they please call the cops? When the officer arrives, politely explain the same thing, asking him to order you to move, (making it an official order,) and could he please escort you to safe haven.... hubby could even point to you, and say something like "I've got my Mrs with me, so uh, could we make it somewhere with a nice 'ladies' bathroom/shower ect?"

    I know that's making a big fuss, but if someone crawls up inside your trailer tiers and has his car chrushed while you're driving "off the books," you stand to loos your job, and get sued by his family, 'cause Johnnie Chocron's law firm is around, even though he isn't.

    bad bad bad if you are involved in an accident. But I doubt the company cares much as long as it doesn't happen frequently or get caught.
