    Got a question for you all was talking with another mercer drive and he was telling me how he got a log violation ticket in Colorado not for driving but for being on duty over 8 hours without a 30 minute break according to him he drove his 8 hours went on duty for post trip had a dot inspection and was ticketed for It I have read the reg and cannot see how it could be interpreted that you can't be on duty more then 8 hours without a break maybe it's me but the way I read it I could be on duty 9 hours take a 30 minute break and drive the rest of my 14 any thoughts or comments would be appreciated

    You have to take a 30 min break exactly 8 hours after you go on duty.
    Start your day at 8 am then you have to go off duty by 4 pm

    The only way that's a violation is if he drove after 8 hours without a mandatory break.
    You can be on duty for 10 hours straight and it's not a violation as long as you never drive.

    That is the way I read this if I am wrong @taylormade please explain

    (1) Start of work shift. A driver may not drive without first taking 10 consecutive hours off duty;

    (2) 14-hour period. A driver may drive only during a period of 14 consecutive hours after coming on duty following 10 consecutive hours off duty. The driver may not drive after the end of the 14-consecutive-hour period without first taking 10 consecutive hours off duty.

    (3) Driving time and rest breaks. (i) Driving time. A driver may drive a total of 11 hours during the 14-hour period specified in paragraph (a)(2) of this section.

    (ii) Rest breaks. Except for drivers who qualify for either of the short-haul exceptions in § 395.1(e)(1) or (2), driving is not permitted if more than 8 hours have passed since the end of the driver's last off-duty or sleeper-berth period of at least 30 minutes.

    I am not saying he lied I know dot has wrote unjustified tickets if you don't know where to go and back yourself up

    Back when I was local when the law first came out was regardless if your driving or not, as soon as you start your day, your on duty and have to take a mandatory 30 before 8 hrs. For example we had lead drivers who would help us with our routes and they never drove a cmv that day, but where riding in a company pickup truck to help us, well they had to take 30 min break also because they were logging on duty.
