    How do they tow trucks in these situations with the brakes set? Because I imagine it has to be done quickly before the driver returns or wakes up, no time to cage all the brakes.

    The tow truck supplies air to the system and charges the system up to release the brakes. The driver WILL be removed one way or another so the tow truck driver can get inside the truck to push in the valves and seatbelt the steering wheel tight.

    So its legal for them to forcibly remove you from your own vehicle in order to tow it?

    All they have to do is call the cops and complain your truck is illegally parked. The truck cannot be towed with someone inside. So if the driver puts up an argument, the driver will be removed forcibly and the truck searched to make sure no other people are inside.

    I think you rights are exponentially diminished in a commercial motor vehicle. Your ability to drive that thing is controlled by the Feds. It's apples to oranges when compared to your personal vehicle.

    First thing they do is pick the front end up. At that point, you're "hooked" and it will typically cost you 1/2 of the usual tow fee to be released at the scene...or fail to pay, they tow your rig and you pay the full amount at their shop. Once you're hooked, they cage the brakes and pull the drive shaft. It doesn't take very long, either...a good operator can have all of that done in 5-10 minutes, especially on most "fleet spec" trucks that only have brakes on one axle.
