Sleep apnea - watching me sleep

I tend to agree with BigTenn here. They only get a message or result when you wake up so they're not actually monitoring you while you sleep; they only know when you wake up, how long you slept, and how well your apnea was monitored. And I guess what I don't get is... if you use eLogs and are okay with that then why does this bother you? With eLogs, they can tell when you're working or not, in the sleeper (OMG, monitoring your sleep sort of) or not, on a reset or not... so what's the difference?

 

That's why I say use it while you drive, as soon as they say "out of compliance" sue them for $10 million and retire from trucking because they violated HIPPa

 

Curious how much experience you have? And why not use it till you find another place? At least then you will be making money rather than sitting

 

As soon as they handed you the paperwork to sign to allow it you should have refused. Now you are astonished that they are using the data you gave them permission to use?
Don't try and say you did not give them permission either. You did. HIPPA laws are very strict. The DME (3rd party company) cannot give them access to that data without your permission.
Now your only real option is to walk away and find a job that treats you like a human. Oh and look into whatever it takes to get the permission revoked. Likely will need to talk to your DME about it.

 

Hi there Trucky, It is a bummer you feel violated,never happened to me-so i cant say how id feel.But this sleep apnea thing is a serious condition from what ive read.Especially for a big neck tub o lard.Its not just the trucking industry-its total transpo-pilots,captains,train engineers etc.
You think you have home time-your on the company time-even at home-(the way they think,lol)again,dont feel bad-im a slave to both my trucks.
They shut you down cause theyre Covering Their ##*!They dont have much concern over your health-their concern is the ambulance chasing attorney getting a hold of YOUR sleep apnea records when n if you get in a fatal wreck.So-dont put too much effort into your privacy being violated.
And,may i ask-how did they FORCE you?

 

USE IT EVERY DAY LIKE YOUR SUPPOSE TO AND PROBLEM SOLVED. its apart of...no way around it besides finding a company that don't care......your company sees it that if you didnt use it at home....you didnt get enough sleep on the night before you came back to work...see the problem.....
You decided to become a truck driver.....now live with the policies or become a bank teller....

 

I find it absolutely bizarre that a company monitors you 24/7 but if you go along they will just keep tightening the leash. I had never heard of such nonsense before coming across this forum. You also point out the person monitoring you is not a doctor or nurse and they are putting you out of service. Whats next? Monitor your caffeine intake?
No #### way I would jump through hoops like a circus monkey for anyone

 

This is exactly my problem with sleep apnea. I don't have it though several members on here have tried very hard to convince me that I do. But I'm with you, monitoring my sleep on my hometime is just not going to happen. I think it is beyond ridiculous.

Now to answer your question, there are thousands of trucking companies that could care less about sending you for testing. However, you have been diagnosed and that makes them liable so I think you will have a harder time but not impossible. There are so many companies looking to move freight that finding one who doesn't check on you won't be too hard.

When I made my recent switch I just blatantly asked if they "bought into this sleep apnea crap". Those were my exact words. Of the three companies, not one said they sent drivers for testing and that it was up to the doctor. One terminal manager who apparently is tired of getting screwed by doctors said he had one that asked no questions and would send me to that clinic.

There are two things that will get me out of the truck, a camera in my face or a CPAP requirement. I will simply leave. So I guess my buttercup self will suck it up and do something else.
