Walmart manager hit my leg with metal dock bar. Serious Suggestions?

    I have flip flopped my position. I forgot we have a ton of expert trucker/lawyers right here as members on this very forum who are full of premier legal advice. In fact I recommend the OP send the video to me, I will post it to youtube for him this way he is out of the legal loop.

    How in the hell is it this guy's responsibility to unload or help out this guy at Walmart?

    Walmart is one of the richest companies in the world if they wanted to pay for LTL service they could have. They paid for truckload service meaning they have a responsibility on both ends. Part of that responsibility is having the personal and equipment to unload the truck. They not only failed on their end, but the guy couldn't even keep his kool or a bit of professionalism.

    If any of this was the result of a failure on the driver's end, would Walmart, or Swift be so sympathetic? This is their ball game they set up the rules:The OP delivered his end of the deal, how about Walmart? Walmart hires a derelict, subsidies his pay with welfare, and then straps him with non-productized equipment, on a poorly packaged load that they packed. And this guy is guilty for filming the circus?

    If Swift and Walmart wanted his help beside driving, they should have paid him for a driver unload. Which they didn't. It isn't like they don't have the money to pay for his work.

    No wife should ever have to handle hazardous materials such as intestinal blockages. This receiving clerk at the Temple, TX dist center, OTOH, should be in the mens bathroom 24/7 carefully monitoring the toilet seat situation. OP, please tell me when this happens and I will proceed to order 5 full Taco Salads from the Wendys at that truckstop nearby, and by the time I get to the Wal Mart distribution center, the 5 previously ate Taco Salads will be practically shooting out of my butt at warp speed. The colon evacuation will be of unimaginable force...and I will smile as I walk out of the bathroom and the receiving clerk walks in to survey the damage and pick the corn out of the tile on the walls. Next time she gives a trucker lip, tell me so I can come by and place a cow pie as big as Texas right on her f'n face!

    I have a friend who had one of their dock workers who had a bad day run over his foot with a powered jack because the guy was called in to work. It was his word against the dock worker and the lawyer had to fight for the video from the security camera. After the regional and legal department of got involved they quickly settled out of court, fired the worker and the other workers received anger management courses to take.
