DAC Question on Abandonment

    Thanks for taking the time to read this. I'll try to ask this as concisely and clearly as possible. Basically, my first trucking job was with Star Stransport, Morton IL. I worked with them for a little over a year, which fulfilled my contract terms. I was asked by my dispatcher, on my last day, to take the truck to a location in Atlanta, where another driver needed it. I did this, I know now that I shouldn't have, but anyway. I did. Well, that was a year ago. I went on to work for Prime for about 7 months, and am now a transporter. I applied to a trucking company yesterday, and found out today that Star put on my DAC I abandoned the truck, and an "incident" which I do not recall at all. So, the lady said she could not hire me with this on there. And I really need a job bad! I obviously called Star, and was told that apparently I abandoned the truck, sorry. So, Question 1 - What course of action can I take to clear this off? And Question 2 -
    -Any ideas on companies that would hire me with it on there anyway??

    Call them up and explain to them that your dispatcher told you to take it to x and that is were you took it. Tell them to remove the abandoment or you will sue them for defimation,lost wages etc.

    I don't like having to use attorneys but at this point, a letter from a member of the bar licensed to practice in the appropriate jurisdiction would probably work wonders.

    The problem you have is documentation, but they have the same problem as long as you delivered the truck to where dispatch told you. The incident that never happened is worrisome, companies want perfection today, they feel they can be picky.

    Yeah, I know. They claim I damaged the fender of the truck in the yard, had a date and everything, was the first I had heard of that. I'm gonna try and have the abandonment removed, the "incident" they may have me on. We'll see.

    Actually, your battle with Star Transportation is MINOR compared to the task of removing the information from your DAC. There is a forum here that specifically addresses what is needed to remove false information and I believe one of the Forum Supporters offers that type of service. Believe me, it ISN'T EASY. nor will it be cheap.

    You know what kills me is that a trucking company can put this stuff on there and then the burden of time and money and lost jobs etc. is placed on us the driver. Amazing. I believe when they report to DAC, thay should have to send in supporting evidence signed by someone, and this evidence sent to the driver also. That way, the driver knows, he has their evidence. I bet we would see a HUGE reduction in DAC problems if that were the case. Now, they just click and type and 10 seconds later they are done. Amazing.

    correct me if im wrong but isn't a dispatcher not supposed to tell you on where to take your truck.

    Well, yes they are. I have been told that I should have taken the truck to the terminal regardless of where the dispatcher wanted me to take it. I didn't know this at the time, and took it to where he told me to. Apparently, it wasn't entered into the system, or something, and he doesn't work there anymore. Like I said, just found this out, so have to do alot more calling etc. Still need a job now though.

    forgot to add

    if need be the records of the qualcom can be supeoned for the case to prove that you had authorization to take the truck were you did.
