I submitted a question to the FMCSA on Wennesday on this issue. I provided a mod here the question reference number and will also work with said mod to authenticate the answer as genuine. I suspect because it is a guidance type question it may take a week or 2 to get answered Until that answer I will NOT believe anybody with tall tales about a big bad DOT type that wrote a driver a ticket for taking a potty break. You want me to believe it POST the #### inspection form and ticket. Is that too hard to understand?

I've said this soooooo many times on here. When you are off duty, you can do anything you want. You can stay awake or eat or stop by your girlfriends or sleep in your sleeper. In 35 yrs of driving/logging I never logged 'sleeper" except when I drove team. (which, by the way, was the original intent of line 2)
If you read the little green bible, you'll notice that references are made to "cannot drive again until 10 hrs OFF DUTY" . Not "cannot drive again until 10 hrs sleeper". You are legal logging sleeper, but in reality, if you leave the sleeper for a pee-pee break at 3 am, you need to log onto line 1. Which nobody does and no DOT cop would cite you for.
I worked for quite a few truck co's and never had any safety guy tell me different.Lepton1 Thanks this. -
395.8(2) says the words "Off Duty resting in a Sleeper Berth".
The regs go on to stress that all changes of duty status must and shall be logged.
The regs go on to stress log falsification will not be tolerated.
Now, I know we are talking about differences in sleeper and off duty time in the eyes of the DOT as per the original poster's question, but I did a quick search and found that @striker was given a violation one time when he was driving, pulled over for a potty break but left the log on the Drive line and was busted at the scale for log falsification.
Perhaps @striker can come in and shed some more light on that event as it pertains to our debate here. -
I said this in the other thread and will repeat it here. There is a huge difference between implied and regulatory.

I think this debate can be better understood in relationship to what you just said. Some of the new people in trucking do not remember the days when most company drivers drove teams. The FMCSA can never come up with guidance proactively like this. The FMCSA has not issued any guidance on this because of the fact as allow me stated the original intent of sleepers was for team operations. IF the states do start popping drivers for misusing line 2 at some point the FMCSA is going to have to make guidance available for single driver use of a sleeper.
